Siam legal ( if you ignore that they are a business ) https://www.siam-legal.com/Business-in-Thailand/thailand-income-tax-for-foreigners.php What the RD says about DTA's I dont think anyone would argue over the reason for DTA's. 2 methods of ensuring double taxation does not take place https://www.rd.go.th/english/21973.html I can find nothing anywhere, that specifically states that foreign tax residents are exempt from tax filing. Or that any overseas monies / incomes remitted to Thailand are classed as non- assessable.

Someone would need to do a breakdown of some 70 million Thias and the 12 million or so that actually file, which is a Thai domestic issue to deal with. If you think about logically. It is going to raise very little tax bucks amongst the retiree expat tax residents in Thailand. As many claim to be legitimately exempt due to DTA's. As many claim they are taxed at home and will legitimately pay next to nothing / anything, due to the tax credit system. Which is pretty amazing considering the bandwith and internet pixels wasted by the subject. Remember, it is not Thailand that is driving any of this. It is being driven by the OECD and Thailand joining CRS.

What I find ironic, and rather amazing, that people can conflate grooming gangs with being anti-immigration. I also find it ironic, and rather amazing, that people can conflate immigration with illegal immigration. To confirm and approve within a week, with no supporting documentation suggests 2 things. 1. The refund was below a threshold that does not require checking ( Which is possible, but I dont think is likely ) 2. Or, as you correctly point out, the RD has access to bank and brokerage accounts. Which might put the wind up some, but does not help those that are legit, looking to stay legit and are only looking for a yay or nay on whether they have to actually file anything.

Can I just make 1 important point about opinions, apart from them being like ****holes and everyone has one. There are generic opinions / There are considered opinions/ There are expert opinions. They are all just opinions, that carry different weights. Regardless of the weight of those opinions,they will never trump what comes from the RD. Which is why I am finding the silence, going back to 2023, rather confusing, and perhaps, even slightly worrying.

I think it would be fair to say that people at the RD know this. Which is why I have just opined that the silence is deliberate and a bombshell might just be about to be dropped. Why would it be game over ? A move to worldwide taxation, depending on the nuts & bolts, might make this house a 5 month holiday home.

You / me / or anyone else cannot draw any conclusions from the above. But I will give you something to ponder. I joined the original tax thread when it was up to about Page 85. I said on that thread that the RD could put a halt to all the speculation by issuing a blanket statement, along the lines of " For people who are tax residents, from DTA Countries, carry on as normal, nothing has changed for you " Over the course of 2024, there has been video after video by people like Mr Hart, expatthaitax and a few others. Cannot recall anything coming from the RD. And whilst I am not going to critice the above 2 in anyway, and I believe that they are acting in the best interest of the expat community, they are not the RD, who are the entity that really matters. We are now in 2025, the tax filing season has started and still not a word from the RD. I could speculate, but I will refrain. I'll just say, that I will not be surprised if something drops soon that may well cause a few ripples. The silence from the RD has been deafening, and sometimes that is not always a good thing.

A classic chicken and egg scenario. DTA's are International Agreements and are separate from Thai Domestic Policy, and there is very good reason for not incorporating these into domestic Law. The UK trying to leave the EU and issues with the ECHR are 2 recent examples of why it is not always a good thing to incorporate International Treaties into Domestic Law. Keep them simple, Agreements that can be cancelled by either Party, rather than getting them tied up in domestic law, where they can become a difficult to get rid of, if the need arises.

Thank you. That is all I have been saying Thailand can put out a blanket requirement for retiree tax residents to report of all remittances to Thailand. Here is Mr Hart. I actually agree with Mr Hart and Thailand, for whatever reason is being sucked into the OECD He is absolutely correct, to be concerned, to be outraged, but it is happening. I do not know the reason why, but things are happening behind the scenes that will impact us people.

I never mentioned CRS. I asked you a simple question. If I was a retiree resident alien in the US, would I need to file a tax return in the US. You dont need to explore it, I already know the answer. The question I am asking you. Is what you have against Thailand doing what the US already does. Furthermore, to cut out your whataboutery Show me in any DTA with Thailand that says an income of any type or description is not reportable if it is remitted to Thailand, should a Thai Government Agency request / mandate it.
