  5. Guess what? For a formal state of war both sides have to declare war. So, as long as as the Russians didn't declare war, there can't be a war? And Ukraine's laws don't count about what constitutes war and what doesn't? On top of which, your thinking is way out of date. The concept of war has been replaced by International Armed Conflict. And no formal declaration of war needs to be declared for an International Armed Conflict to be recognized as such.
