    Perhaps she is one of the Thai shareholders that "own" 51% of the company?

    On the advice of my lawyer, I have just transferred the shares in my company from the original proxy shareholders put in place by the previous owner of the condo into the names of my girlfriend and her son. I'm still the only director of the company so I'm the only person that can sign documents etc.

    Just curious, if it's a condo, why have shareholders and not own it outright as an individual?

    I guess because the farang quota of ownership for this condo has been reach...

    Basic Advise = NEVER involve your Thai gf, wife with your business or properties.

    Being Director give you the power to sign documents, correct, but the legal owner of the company (with 51% shares) can decide to revoke your power anytime and grant the power to someone else and also legally own 51% of the company properties...

  4. really out of curiosity, i notice that you did have more than 3000 messages on tv, so here my question: Are you one of those members

    who spent their times claiming how much their gf/wife is different, that she come from a good family, she is so honest, you can trust her with you life, she will never harm you, she is the best thing that did happen in your life, and she love you maak????!

    (Well inspite of warning, the cultural gap, language barriere, difference of wealth, her family, etc etc)

    Because if you are one of them, who spent his times to spread myths and <deleted> on tv, well in fact you might have fooled some other members, but the biggest victims is...you!

    Now its time for some weeks holidays, and after to start to build back yourself, and dont run again in the same problems as it seems that some never learn.......

    I'm one of the guys who didn't discover Thaivisa (or really know anything about Thailand) until AFTER I married my wife.

    Now I would actually say my wife is very DIFFERENT because most Thai people are not evil monsters with NPD.

    I have also met a similar Thai devil. Within a few years, it end in a divorce when I discovered her same bad side (NPD).

    After the divorce who cost me lot of money to compensate her, she used the kid to blackmail and get more and more money and Thai justice doesn't care about it, I wasted 3 years in court, she is the mother and Thai, she can't even be blame !

    Now she give me a break as she found another poor folk to treat in the same way. It will take some years to him to discover what monster he married... love make people blind...

    Seems lot farangs don't learn about other farang stories. Luckily, I was aware and never involved her in my business and got prenuptial aggreement, so I saved my AS/SET even she tried to get half.

    I wish you good luck for the future, you did not mention if she ran away with the kids or not... more than the money and wife Relationship, it might be the next painful point...

  5. DNA test, named on the Birth certificate means absolutely nothing in Thailand unfortunatley... You are only the legal father if you...

    1) Marry the mother

    2) A court recognises you as father

    3) The child (when older) identifies you as the father in front of Amphur officials.

    Yep that is correct, and for the point N°3, seems kid should be minimum 7 years old.

    I advise you to make a DNA test at Police hospital in Bangkok (located near Central world).

    It take 3 weeks to one month to get result.

    You should go with mother and kid.

    While you have this document and birth certificate, you must hire a lawyer and proceed to court to become the legal father and get custody.

    I guess the court will ask you to pay a monthly child support, around 10,000 Baht to mother

    First off, AXA Thailand, while part of the AXA Group, the French multinational, operates as a distinct Thai entity because of laws that require Thai shareholders etc.

    Which insurance unit is it? If it is really the life unit which I doubt, then complaints should be directed to KrungThai Bank, not AXA because Krungthai is the key stakeholder in AXA's Thai life operations. If it was AXA Insurance PCL. then AXA is only a major shareholder and the day to day operations including claims paying decisions are 100% Thai controlled. Key Thai shareholders are the Thai banking group UOB, and TISCO.

    AXA is a brand in Thailand, and it's convenient to point a finger at the brand name rather than to acknowledge it was a Thai decision not to pay the claim for the specific reason that terrorism and insurrection is an exclusion. The bigger issue is that had the government not invoked the description,the policy holder could have been paid. In order for the policy exclusion to be used, there had to have been a legal declaration by the local authorities. As an aside, the business community did raise this possibility at the time, and its counsel was ignored. An insurrection is what we see in the south. What occurred in Bangkok, was illegal, it could be described as violent riots, vandalism, assault etc., but it was not an insurrection in the conventional legal sense. The declaration of insurrection was to allow the government to suspend civil liberties and to more easily deploy the army. The end result is that the policy holder suffered.

    The insurance contract should be with AXA Plc, the claim is not about life insurance.

    Regarding the case, every standard insurance contract exclude rioting, civil war risks etc from the warranties.

    It will gonna be hard to the plaintiff to prove that the situation was different.

    Better then to send the Bill to prime minister who will transfer it to some relative who is hiding abroad...

  7. I remember reading a while ago that one middle eastern airline, Emirates I think, have effectively valued their A340-500's at zero as they are so inefficient and nobody wants them. How Thai can put such a high book value on them is beyond me.

    It's what they do.

    Planes, houses, cars, rice all over valued on the books. To quote market value would require a loss of face by them.

    Thais will keep a house in a moo baan, unoccupied for years, slowly deteriorating and still attempt to get top value for it.

    The concept of "Sunk Costs" is alien to Thais. They'll never understand that something is better than nothing when it comes to business. Those planes have been flown for untold millions of miles and have carried an untold amount of passengers and have no doubt paid for themselves, but the Thais insist on playing hard ball for their price for planes that they will never put up in the air again.

    Of course you are right but they still operate few Boeing 747 !!! I am wondering if the 747 is more costly than A340 500...

  8. Lemoncake, I have huge experience to deal with staff over the years, please believe that no staff cannot be replace.

    She is not the only one people in Thailand who can do a good job especially if you provide a good income with bonus !

    By the way, I remind you, you have deal with her and she took responsability of your house while you was away.

    Your house has been damage and you personnal stuffs missing, she is responsible as she took the responsability of the job, that's it.

    Be strong, don't find excuse to her because you appreciated her past work, you have paid her for for it, it was her duty !

    If you don't do anything against her, she will think that you are stupid to let it go and might not respect you anymore.

    If I was you,

    1) I will push the squatting people and their stuffs to move out of the property and claim to call the police if no action done

    2) I will have a direct conversation with her explaining the facts with a list of damages.

    You can estimate the cost and suggest her that you might withdraw from her salary for a period of time.

    3) If she do not want to take the responsability of the claim, it is mean that she is not trustable person, she has to leave the company as soon as possible.

    Dont be too kind, as you seen, you did not desserve what you got and might regret it more later !

  9. Last month, I have been to Immigration in Chaeng Wattana applying the one year extension of stay.

    I bring my kid with me and the folowing documents :

    Copy of child Birth certificate

    Copy of my passport

    Copy of Laos visa and entry stamp on my passport + TM card

    Copy 2 Tabianbaan of kid and me at same address (Yellow and Blue one)

    Copy of Divorce certificate

    New certificate from the bank showing more than 400K at Thai bank

    Copy of the book Bank with update OF THE DATE OF APPLICATION as they requested it

    Photo of me with the kid at home

    Map of the location of my home (print by Google map)

    First officer looked at the documents, and asked me the id card of the mom then I explained that we were divorced and showed the divorced certificate.

    Then she asked me the school certificate for the child, document that it is not on the list of documents they requested on the form !

    So I answered that I did not bring and she showed on the Thai version of the form that it was requested...

    I kept my smile and return the page, asked where it was on the English version as none was printed...

    Finally, she asked in Thai her supervisor behind her that who invited me to come and seat with the kid.

    She checked few times all the documents I bring and asked me if the kid was going at school, I said Yes of course and she said please, next time bring the school certificate.

    Then we proceeded to took a picture with the kid and I made the payment. They stamped my passport with a mention that my application was Under consideration, must show up again one month later...

    I did not go out the country during this period as I did not know if I was able to do it without a new re-entry permit. Anyone know ?

    On the date of the result, I gone to immigration with the school certificate that was not finally asked... Nothing was asked, Passport was stamped with a one year extension starting the end of the visa issued in Laos.

    I am wondering if the kid should come again next year for the renewal of the extension, by the way, job done !

  10. As a father, i empathize and I will immediatly give a call to the boy to put pressure on him. I will let him know that I am aware of the problem and will take action against him if this happen again.

    Second step, will contact the family.

    Third step, hope not reach this step.

  11. I was married for 2 years to a thai lady we have a young son almost 2yo.

    We divorced last year.Everything I had before we were married I kept

    .Everything we accumulated together we split 50/50.We used a thai lawyer to draw up a fair settlement and also a custody sharing agreement.

    We had gold toether which we split,and 2 cars,so took one each.

    Because our son was young she was the main carer and I agreed to financially support them both as well as have regular contact.

    At the time she wanted to return to work when our son turned 3,so the lawyer put in the divorce agreement that I would take custody when he turned three and that she would pay me money(3000bht a month)and she could have access regularly as well,obviously her alimony was smaller than mine because of her earning capacity,but at least it was a gesture.

    All papers were lodged with the local amphur in hua hin.

    I was lucky that my ex is areasonable person and we had our sons interests at heart.

    Soon after we separated she actually moved to a house only a few doors from mine so I could have more time with my son,we have a friendly and amicable relationship.

    It all depends on your attitude to your partner and hers to yours,i tried to make it as easy as possible....oh and it was her who wanted a divorce,we just couldn't live together,..i think too many cultural differences....but we are both better people for the experience and of course having a wonderful son

    You are lucky, all Thai women are far to be like your ex !

    I was also "lucky" as I made prenuptial agreement but it was and still a nightmare on the kid custody matter...
