  1. Ok, I need a new accountant.

    My officestaff handle all the documents, deal with labour department, witholding tax etc..

    My accountant only have to make the final financial statements and take care of the Revenue Department.

    I pay the accountant 120.000 THB/year.

    Every year revenue depart "must" give around 1.000.000 THB on VAT returns, because I only export.

    Till now I never received 1 satang from them, the accountant tell me they can also not help me.

    Does anyone know a good accountant with connection within the revenue dep.

  2. Just wish to add that they always requested that tax payment doc from land office from me when applying for extension. Mine is above 3M Baht. Cheers!

    My Tax Payment doc show 2 values (head of document)

    1. Transaction value (market value)

    2. Estimated land Dpt value

    This value is estimated by Land Dpt per sqm, depending only of the location (district) and never changed since 4 years.

  3. I have just returned from attempting to extend my permission to stay for another year, based on owning a condo worth more than 3M baht. As everyone probably knows, this was abolished for new applicants last year and intially it was stated that existing aliens in this category would also not be given any further extensions. However, after a lot of panic, this was changed and existing users were "grandfathered" in. Subsequently, I extended my permission to stay by one year.

    Today, I was not expecting any trouble, but I was refused an extension. I was told that the law has changed and that they no longer consider the price you paid for the condo, but instead look at a price which is assessed by the government. On my receipt from the Land Registry these figures are given as ราคาทุนทรัพย์ 3,500,000 and ราคาประเมิน 2,270,000. Effectively, they now consider that my investment is 730,000 baht too low. If I put this amount in a bank account, they would give me permission to stay (initially they said I would have to put 3M baht in a bank account, but then one of them produced a procedural manual and decided that the investment does not have to be in one unit). They emphasised that this amount would have to stay permanently in the bank, and produced a letter in English to this effect.

    I pointed out, and they agreed, that I have had four previous extensions granted on this basis but they stated again that "Immigration has changed the law" (this was said in English, twice).

    Needless to say, I do not have a spare 730,000 baht which I can put in a bank and not touch for ever, so I now have 26 days left in Thailand to sort this out.

    Has anyone encountered this problem or does anyone have any ideas?

    This problem is not new and the law did not change this year.

    I am curious to know where you applied your extension as this rule is currently applicable at Suan Plu since few years.

    3 years ago, I applied for the 3 M Investment visa for my condo that I bought 4M Baht.

    The estimated Value of the land department is around 2,75 M and I was requested an additional investment to reach the 3M.

    I was very upset and I asked to meet the manager in charge. I explained to him that the rule was not clear and that I invested in Thailand really more than 3M.

    I showed him the Bank transfer forms, Thor Tor 3, etc, then he gave some calls and I was granted !

    The second year, I applied for extension of stay and they requested again 300.000B...

    I claimed that the extension was grandfathered the year before but they said that I got a sort of "exception" and that the manager changed now...

    So I opened a fixed bank account at OMSIN (front of Suan Plu), made the deposit and got bank certificate + copy book bank for immigration.

    Every year, I should update the book bank and request the same certificate to show the money still here.

    In your situation, I would try to negociate with the manager, claim that you got extensions 4 times...

    Tell him that you don't have the funds now and that you could show to them next year, I don't know.

  4. I am not affected as I won't qualify for a retirement visa for many years to come, but this new rule is truly stupid and cruel. Why make it harder for foreign families to stay in Thailand? I can't think of a single reason. At the same time, those that are affected by this rule will be hit very hard. And others who maybe could come up with the money will probably leave in disgust.

    What kind of government invents new laws that specifically hurt families? It boggles the mind.

    PS: I think one needs to view this in the context of ever-increasing anti-foreigner laws and increased isolationism in Thailand. It's sad because it hurts the Thai people the most.

    Good point on condo prices too. I was in the market for a condo but now, not anymore. Not because of this specific law, more like because of the general direction this country is taking which virtually guarantees that the ROI becomes smaller and smaller... retirees getting kicked out, hard to move money out of the country, etc etc.

    I am exactly in the same position, you think right...

    Hope new elected gouvernment will change these new rules :o

  5. 3m invested in a condo or govt bonds / bank etc. has been withdrawn but they "sayY" they will grandfather people already in the system. For how long and whether they really do so remains to be seen.

    I do know that if at all possible, I would leave the 3m alone as once withdrawn I suspect you lose that visa.

    It does beg the question though about investment in one bank or in one condo. What if you move banks or sell the condo ? how long do you have to reinvest to maintain your investment visa ?

    I do believe that if you withdraw your 3M Baht investment from Thailand, you must leave the kingdom within 7 days as your extension of stay will be automatically canceled (remember, Immigration office asked you to sign a document that if you remove your investment, you should inform them immediatly).

    I hope (but not sure) that if you sell your condo and maintain your investment in Thailand (immediatly transfer the money to a Thai gov Bank, OMSIN, etc) you will keep your visa... :o

    I legally owned a condominium since 3 years and I am planning to sell it for buy a bigger one.

    Does the Land department will accept to transfer ownership if the funds used for pay the new unit are partially issued from a previous buying/sale ?

    May I use the previous Thor Tor 3 (from 3 years ago) for show the money transfered from abroad in foreign currency to proceed the transfer of ownership of the new condo ?

    Do foreigners need to get work permits to be partners in either unregistered partnerships, registered unlimited liability partnerships or limited partnerships? The situation would that of one foreign partner (non-American) with two Thai partners and the foreign partner is an investor who is not a managing partner and doesn't even work in the business. I assume that he would still need a work permit but would be happy to be told otherwise. Thanks.

    If he does not work in Thailand or sign company paperwork such as audits inside Thailand, he does not need a work permit. He may need to show proof that he was outside the country when signing the audit if he ever applies for the work permit later.

    Does the fact that the foreigner and shareholder sign company paperworks (banque cheques and/or audits documents as director) obliged him to owned a work permit ???? :o

  8. Last year I got a one year extension on investment grounds (3 million baht in a fixed deposit) just before this type of visa was withdrawn. I have two questions:

    At the time I was told that although this type of visa had been withdrawn existing holders could continue to renew. Has anyone actually been able to renew since October 2006

    I applied for the orginal extension in Bangkok. Can I apply this year in Pattaya

    I will apply for a 1 year extension in one month (for the third time).

    As Sunbelt posted, my lawyer also confirmed to me that it will be no problem.

    I applied few weeks ago in Suan Plu and everything was done THE SAME DAY !

    Usually, they extended my stay for a month until they checked everything (again and again) but this time they proceeded immediatly (seems the process changed).

    tourist visa back to back to back to back. But I have not tried the same consulate yet.

    As an FYI, my case is not to screw anyone. Just have a relationship from home country, are not married yet, so while one of us is legal work permit holder, the other needs a tv every 90 days. Supports the country and the economy, especially Air Asia for the flights out of the country....

    Every farang living in the LOS support the Thai economy in many ways by spending overseas money here :D

    Obviously, it is not consider by the Thai immigration laws.... many of my friends without long term visa and below 50 years old feel very upset about it :D

    One of these friends applied last month in vientiane for a second Tourist visa and got a double entry that give him 6 months (with 2 extensions and one run)... :D

    Each time he was there, he always saw a very long queue of 50 to 100 peoples requesting a tourist visa ... I guess Ventiane consulate is making a LOT OF MONEY in tourist visa issuance business... :o

  11. Just to confirm what one member has already mentioned. All the Immigration entry booths have a new Yellow A4 sheet posted prominently stating the following requirements for entry:

    1. Passport

    2. Arrival/Departure card

    3. Boarding pass

    4. Return ticket/e-ticket

    I would hazard a guess and say that requirement 4 only pertains to entries without visa. Both my Filipino companion and I had tourist visas and were not asked to show return tickets. We entered on June 1.

    I am confirming it too, I arrived 2 days ago.

    I have 1 year "O" visa and was not asked for show any ticket and boarding pass.

    I noticed that the previous guy without visa showed his return ticket to the officer before get stamp.

  12. I cant help but laugh at the posts that Simon often puts up. For such an obviously clever guy, I am surprised he has very little common sense. Its so easy to set yourself up here legally - forming a company that owns a resort among other activity - him as the MD and after 3 years of paying taxes on his declared salary he can apply for residency. Really, you should have thought about this a long time ago instead of playing with coffee shops. beer bars and everything else you have dabbled and then failed in. The failure part is part of life, no shame in that, but what surprises me is that certainly in your posts you come across as somebody who 'believes' that Thailand owes you a huge debt. Personally I dont agree, and seemingly nor do immigration - lets face it - you have lived here, probably spending money that was generated here (by using your brain) - yet you have not paid one cent in income tax. Personally, I am not at all surprised and cant help but wonder how you have not developed a strategy to enable you to live here. It was the first thing I did when I came here - some ventures have been good, some not so good, but the crux of it is that my company is well established, with employees and all of us pay tax. My last work permit and visa renewal was actually done in 3 weeks - by far the quickest to date. The key is looking at the rules and developing a strategy to help YOU in what you want to achieve, yet all you seem to do is lurch from one crisis to another because you think your smarter than everyone else. What was it that Helmsley women said "only little people pay taxes" shortly prior to her being taken away to prison for tax avoidance. Some things in life are certain - death and taxes are at the top of that list.

    I dont mean for this to come across as negative but really who have nobody but yourself to blame. Anybody with half a brain cell could see that 5 years of Non-imm B visa's would come back and bite you one day, as basically you abused the system.

    and with so much income, you can pay a good lawyer able to find the best solution for you :D

  13. I want to buy a condo ideally close ( walking distance ) to MRT ( or BTS as a second choice ) that is new and ready now or ideally in the next 7 months. Any suggestions where in Bangkok such a property is available ? I work in Ladprao and want easy access to the MRT. I hope to get a big loan ( 90-95 % ) from a bank here - is that possible ? I am a farang with a work permit - currently two year contract. I want a condo at least 70 sq m and a 1 or 2 bedroom is ideal. Any help appreciated .....

    I think you can get a Loan at BBL by BBL Singapore, no choice for foreigner as Money must be transfer from abroad.

    If you are looking to buy a condo, I plan to sell my unit end of this year (70 sqm, 2 beds not far from Lumpini MRT).
