  2. Yes Hi SO, Medium So, and many VIP's including 2 past Prime Ministers, ex Ambassadors, another Sister PM nominee in waiting, and more than 1 general. The condo is not popular with the Landowners and I am sure that they will have their way in the end.

    BTW the number is far less than the 70% you have been told and if this is where your info is coming from you should be very suspect. In any case what bearing does this have, other than the Landowners are pissed at GV over the condo and other issues

    You may wish to check if the condo itself has been sold and if the problem of access was the reason for that sale. I suspect that there will be no reason for the sale forthcoming, but the fact alone would make me suspicious

    The question of who sold the small strip of land to the condo is not important. The key bit of info is if that sale was based on obtaining access via GV, and if there are any skeletons in the closet over the current problem of access.

    We all agree that the condo bought the small strip of land up to the fence for an exorbitant amount. The question is if the condo or anyone else for that matter has the legal right to breach the fence, and/or if GV has the right to sell or grant access through the fence.

  3. The sliding gate to the condo is the problem as it breaches the mooban fence and this is not allowed. It was done without permission, permits or any legal right to do so. The fact that it exists does not mean that it is legal nor that it will not be removed and the fence returned to its original condition. Neither the condo nor GV has the right to breach the fence and that is the crux of the problem.

    Khun applies to both sexes and it is a Khun that is embroiled in the legal problems of selling that small strip of land between the condo and the mooban fence. A title to that small strip of land no doubt exists but that does not guarantee access to GV. You may wish to think why this Khun is now having a problem in selling that small strip of land and the promise of access to GV

    There are a lot of VERY important people living in GV and the condo using the road for access is not a popular move.

    If you want to buy there in spite of the construction issues go ahead, but do so with your eyes very wide open over the access issue and how this will all play out. I would not invest money in any project with a legal problem or even a hint of anything not completely transparent

    caveat emptor applies in land deals in Thailand more so than in my home country

  4. The condo cannot lose access that it never had in the first place.

    The breach in the estate fence is the problem as an estate fence is inviolate and the breach is illegal no matter how, by whom, or when it was breached. A security guard can watch it until hell freezes over but it is still an illegal breach of the fence and this is the legal point that prevents access.

    The narrow strip of land you mention was sold by the Sister of the original GV developer so that the condo could have access (via the beached fence). Since there is now a big problem over access via the GV fence, the subject lady is embroiled in legal problems of her own regarding this land sale.

    In any case the building integrity is questionable due to sitting open for far too long

  5. I would not be so sure of the access via the Green Valley road and as noted the Homeowners Association are dead set against it. As I understand the situation Condo Owners will not be allowed to use the GV road. The sticking point is that the mooban fence is inviolate and cannot be breached by the Condo no matter who or what they buy in GV. Lawsuits will tie up this access issue until your condo investment is useless

    The small bit of land between the condo and the GV road was bought from the local farmers, and resold to the condo with the understanding that this would allow access to the GV road. Now that access is not forthcoming this is the subject of a pending?? 30 million B lawsuit against the Seller

    I would give some serious thought to buying a condo knowing that access will not be allowed via the GV road. If you want to access via a rural road that is another question

    Second issue is that it sat exposed to the elements for over 15 years

    Note that the number of parking spaces are far less than the number of condos, and you will be parking on that dinky rural road

    I too have been inside the building when it sat for all those years and would not live there never mind buying one.

    I am told he now brings in Mobil 1 fully synthetic 4T bike oil
