Hi, 

 

I'm new bee. I suppose this topic has been discussed before but since the regulations keep changing every year I want to ask individually.


I have Non-O(spouse)  which was done at (Korat) Nakhon Ratchasima Immigration last year in Feb 2017 by an agent.
Now I have few question(in red) as follows:

  1. I ran out of pages for which I have new Passport and visa transfer document from Embassy. Do I really need to transfer my visa to new passport? even my visa is going to expire in March 2018. 
  2. Can I transfer my Non-O visa to Non-B(employment) at CW Immigration? because I have job and WP from Thai Company in Bangkok and HR asking me to transfer my visa from Non-O to Non-B because when HR contacted immigration office for my visa procedure they said Non-O visa which was done at Nakhon Rachsima can not transfer to Non-B(employment) because they have no record. Wonder! Aren't immigration offices are connected to central Immigration system for records?? Therefore HR wants me to exit and come back with Non-B from Thai embassy at home country. 
    Is there any solution without exit Kingdom and have visa change from Non-O to Non-B ?? 
    What if I exit Kingdom and go to neighbor country like Malaysia, Laos. Can I obtain Non-B from there while having visit visa of that country?

Visa are not transferred. It seems you have an extension of stay based upon marriage (it is not a visa). You must transfer the stamps in passport to the new one.

You cannot change from a non-o visa to a non-b visa without leaving the country to apply for a new visa.

You can get a work permit and work with an extension of stay bassed upon marriage.

Or you could change the reason for your extension from marriage to working but that ties your extension to your job which is not the case with extension based upon marriage.

I have learn't new thing  they call VISA a sticker on passport...  and other is EXTENSION STAMP for 1 year... Fine!

 

Now, as you said ''leave the country to apply for new visa'' does that mean option to go to neighbor countries is possible of have Non-B if applied with all supporting documents?

As Ubonjoe has stated, you can legally work whilst remaining on your current extension of stay based on marriage, you do not have to change this to a non b unless you really want to.

You're quite right.
 

I have couple strong reasons to change my visa from Non-O to Non-B(employment) because as per my job contract, company should pay for my WP and Non-B visa/extensions BUT since I have Non-O they refuse to pay for it. After they come to know its been done from Korat Immigration and CW immigration officer suggested to re-enter with Non-B. Second, taxes on Non-B are lesser than Non-O as my HR explained. Is it true?

 

And I need simple explanation... rather I go to home country which is far distant, Can I go to Myanmar, Laos, Malaysia any of neighbor countries to have Non-B visa whilst holding visit visa of that country?

Your personal income tax liability will be exactly the same, no matter what visa or extension of stay you have.

 

The biggest advantage of being on a non o or extension of stay based on marriage is if you were to ever lose your job, then you can remain in Thailand, with an extension of stay based on working, then the permission to stay is cancelled on the day that the work permit is cancelled and you would have to leave the country and start the whole visa / extension process again.

 

I'm sure that ubonjoe will reply regarding where you can go to obtain a single entry non b visa, last I heard this was available in Penang for sure, although you will need all of the accompanying documentation from your company, this would apply no matter where you were to make the application.

Its relief that flying to home country is not compulsory to re-enter with Non-B 

 

Now waiting for @ubonjoe  confirmation in same regard.

The company wants you on an extension of stay based on working (having you convert from Non O to Non B is unnecessary to achieve this, except that they need to wait until the last 30 days of your current extension before it is done) because it gives them leverage. Once you have done it, you will be forced to leave the country if you leave the job. That is why you should resist this change. Frankly, if they insist, do not take the job. They are planning to take advantage of you. The fact that HR is lying to you about taxes (they must know what they are telling you is untrue) is another red flag.

Most apply for the Non B in Vientiane. Several other consulates in the region are also fine. This does assume that your nationality does not mean all visa applications must be done in home country.
