Thailand’s Constitutional Court has rejected the ombudsmen’s petition asking the court to rule on the legitimacy of the National Council for Peace and Order appointing a committee to select senators.

 

In the petition, the ombudsmen challenged the legitimacy of NCPO Order No 1/2562, pointing out that it might violate Section 812 of the Constitution because the order was not published in the Royal Gazette.

 

The ombudsmen also pointed out that one of the senator selection committee members was later found to be a sponsor of a political party that fielded candidates in the March 24th general election and whose MPs were involved in nominating a candidate in the election of the Prime Minister.

The ombudsmen way as well go overseas on a "education and fact finding" trip to gaze wistfully at others doing a similar titled role whose reports are taken seriously and are the basis for action and legislative change,

Everything the ncpo did is illegal. None of the legislation was conducted with a valid mandate. It is hardly rocket science.

 

It is very clear, this courts consist of people that have no idea about rule of law at all..

More likely, 'this court consists of people that have no interest about rule of law at all.'

I can see no way out for the Thai people, as EVERY official body and institution is eaten up and consumed by militarist rapacity and oligarchical greed.

I never thought I would witness such a situation in my life.

It is shocking and disheartening - to say the least.

 

But the great Prayut can now boast (as he is doing) that 'we are the elected government of all Thai people'.

And the West appears so far to be going along with it all!

 

Honestly, I don't know where the Thai people can go from here. Well, I do -  but that option is clearly off the table ...

I disagree. I think that they unequivocally understand the rule of law but they receive orders from a much higher up on how to act, what to say, who to screw etc.

I can't see anything wrong with filling the senate with your mates to vote for you as PM. Doesn't this happen with all dictatorships. Absolutely true to form. R.I.P Democracy for Thailand.

 The principles of judicial office are different here!

Political expediency at play by the court once again. Rule of law will have to stand in queue. 

That is so precious of the court to do that. Where is the justice of what is truly right?

  • The ombudsmen argued that the junta’s role in the screening and appointing the senators amounted to a conflict of interest.
  • The Constitutional Court ruled, however, that Order No 1/2562 is legitimate because the order is not a regulation that is generally enforceable, but merely relates to appointing a committee to select senators.

That's news to me that an NCPO Order isn't enforceable - Article 44 says NCPO Orders have legislative and judicial authority. Period!

Might want to update the name of the Court to Imaginary Court.
