I currently have a non Immigrant O multi visa based on marriage (visa obtained overseas). 

 

Am I able to apply for a work permit with this type of visa or do I need to wait till I extend the visa at immigration for a year based on marriage. Or do the two visas confer the same rights?

 

I have my name on the yellow house book already if that makes a difference.

You can obtain a work permit with a Non Imm O Visa based on marriage.

Yep, I have that set up currently. Married extension and a work permit. Been doing it for years.

But I'm not on the extension yet....

Does not matter, I was not either originally. Just happens to be the case now.

Yes you can apply for a WP with a Non O visa status — because you’re married to a Thai. It can be applied for whether you have a 90 day stay permit or have extended that stay.
