Is this a new one? Not that it matters but I don't remember this last year or before. And boy it looks to not even being guilty but stuck in the court system and then maybe not able to do renewal or leave or leave to get a new visa. We all know how long the court system is here. Can be years.

 

What if you are on overstay and immigration arrests you and then hold you and prosecute you. Is this the same? You certainly only have to be on 1 day overstay is how it is worded to get black balled out of the country for 5 years. Now that is just brutal if that is the case.

**In case of aliens being arrested and prosecuted

Overstay of less than a year forbidden from entering the kingdom for 5 years.

No it’s not new.

 

As the rules stand — if your caught on overstay, even 1 day, you can be prosecuted and banned for 5 years.

I read it 2 ways. Real court system and the immigration handing down their verdict. 

So it says if arrested and prosecuted you will be banned for 5 yrs. That is a no ifs and full butts there!

That is only if you are caught with an overstay.

If you were arrested jailed for a crime you might not be on an overstay.

In many cases you could be released on bail during the court proceedings and could get extensions up 90 days at a time for being involved in a court case.

Well at least they let you get to the airport, check in and then don't rack you up. It's only the in-betweens that are dangerous. I haven't overstayed in over 25 years, so this will hopefully never apply to me. Hated their attitude back then. So gruff. But then again that was Don Mueang back in the day as well. For the arrested for the crime, just hope they don't see you as a flight risk and you can make bail.
