My situation is as follows:

• I currently have Extension of Non Immigration B and Work permit.

This has been the case for the past 3 years.

I have been sacked from my job, 7 days ago.

I will be paid until the end of May.

• Question 1: I am aware that my Visa and WP will expire because of having no job.

This is in 7 days time.

But, from when? The date of dismissal or the end of salaried payment?

• I am over 50 years old.

I am not married.

I have a Thai daughter, 8 months old.

I live with my common law wife, her son, 7 years old, and my daughter.

It is a settled and happy family.

• Question 2. Visa for Thai child to support me?

Contradictory information received.

Possible?

How to do?

Documentation?

Need to be married?

• Question 3. What to do?

Cannot retire as yet. Awaiting property sale in London.

Ditto marriage.

• Question 4. Where, how and when to do it?

Apart from runs to Poi Pet years ago, I have always been hand held in Visa and WP applications. International Schools took care of that. I just smiled when appropriate, sat quietly and allowed Suan Phlu and M of L to go about their business, in conjunction with a Thai representative of the appropriate school. Never a problem.

Until last July. New job in horrorshow circumstances, culminating in the sack last Friday.

Having previously had an easy time with being fully legal in Thailand, the last year has seen a complete breakdown of a stable situation.

Advice gratefully received.

Have they told you when they will return the work permit? Believe the drill is that is returned within one week and you then have one week to leave the country. The above posts provides about the only extension option open to you and as said a consult with Sunbelt Asia would also be my advise.

As for what to do in the future that is up to you. I would think there would be a number of teaching opportunities available with the current visa situation.

If you need to leave a trip to Laos or Malaysia to obtain a tourist visa would give you some breathing room.

Page 31 of WP: Warning "In case where the alien resigns from the work which is specified in the permit, He shall return the permit to the Registrar." After not being issued with a Contract in 10 months, and having finally being told that the Contract at the M of L is the valid Contract, despite everone else holding a school contract, my employment was terminated. I still have the WP in my possession. Hence my question as to the appropriate date to return it. One week after firing, or at the end of the month (payment to this date promised)?

I have consulted Sunbelt and it is from that source that the confusion over marriage status emanates. They say I do, but previous posts appear to indicate otherwise.

With a London property up for sale, 30 years man and boy before the chalk face (Inner City Manchester and London, Western China, Shanghai and Thailand)new "teaching opportunities" are no longer of interest.

My questions could be placed into a context of covering the next 6 months before a luscious retirement sets in.

Well I would say you were given notice that your employment was ending at the end of the month so that would make return within the first week of next month acceptable.

It is not a problem to obtain tourist visas; or non immigrant visas for single entry in Laos or Malaysia. Birth certificate and perhaps letter from mother should be enough to obtain and that would provide 90 days at a time so would only have to do twice to cover the six months.

From when your work permit is handed in.

Technically, you qualify for the extension of stay based on being over 50 years old and having a Thai child.

However as you are not married this is where it’s complicated.

The Immigration Dept then requires that you must have a certificate from the District Office that you are the father of your 8 month old daughter.

In order to get this certificate, the District office requires that your daughter must sign stating that you are the father. As she is only 8 months old, you then need to go to the Court so that the court official signs on behalf of your daughter that you are indeed the father.

If you were married, no need for the certificate. Can you still get the extension without married? Yes but as your daughter is 8 months old, this will take time to get the certificate.

Hope this clarifies your confusion of why you qualify but don't right now because of the time issue needing to go to court first.

Get a 60 day visa at Immigration inside Thailand to visit your Thai child. ( your name MUST be on the birth certificate and if it is, we can get this 60 day extension for you now)

In the meantime

1. Get the Court Order ( This will take 5-6 months)

2. Find another job

3. Get a tourist visa.
