Husband's(foreigner) approval when selling a Condo in Thailand

 Looking for a bit of advice.

 

We're planning on selling a Condo in Bangkok.

 

We live part-time between London and Bangkok - Thai wife, English husband.

 

My wife believes we need to get a consent form from me re the sale. The condo is in her name, but we're married, but we weren't when we bought the Condo over 7 years ago. 

We have no mortgage on the condo, all fully paid-up.

 

Anyone had to do the same and what was required re any form of consent.

This is just a thought, I'm by no means a legal expert on this... but - the condo is in a Thai name, the owner is OP's wife, and it was bought before marriage. I don't think the foreign husband has any word in selling it, since according to authorities, the place is 100% owned by the wife.

 

From what I understand in case of divorce, anything that is gained during marriage would be split, but not what was owned before marriage. And condo is in her name, so basically no matter who paid for it, it belongs to her.

 

As such, I do not believe she needs husband's permission to sell it, unless there was some other contract between the 2 partners, prohibiting the sale... Land department would only care about who is listed on chanote. I doubt OP's name is listed on the right side of the table.

 

But hope someone with legal background can give a definitive answer.
