Hello to all,

Have not been here for a while as me and g/f have our bub now for 9 months we have been busy !!!!

I have some questions which i hope can get some answers for or some sort of guidance,

As my g/f is here in oz with me and our bub at the moment and has been here on a 12 month mutiple

and abided by the rules as one has to do... I am applying for the Spose visa !!

Q..1......... Certified copies !! Can i copy all original documents then have the copied docs certified by Justice of Peace?

not including Police check as i realise that has to be original, Just other docs about her Birth certificate which has been translated

and other docs we got translated or do they want all those docs original???

Q..2........ Financial aspects.. They say we have to show that we are sharing financial commitments?? How does one do this as my g/f

is not allowed to work in oz as her visa states and she is a mum, Are we meant to open bank account together and use that as sharing financial commitiments?

She dont get centrelink payments or any money so i am as i understand the sole financial provider..

Q..3........ In the form 40 SP it says about do i owe money to any Australian Government ! What about me owing money to the Tax dept !!

I am paying it back on a weekly basis so i am wondering would that jeapordise her spouse visa application?

Q..4........ I have been informed by immigration that as we have a baby together who was born in Thai but now has Australian citizenship

that it is a lot easier for been granted a spouse visa?? Is this true or not??

Q..5....... My friend who is applying for his Thai wifes visa for permanent visa said you have to pay the $2000 odd bucks plus a $4000 deposit of

some sort which they give u back after 2 years? Does that apply for our type of visa ? As they told me back in march that we would only have to

pay the $2000 odd buks only???

I hope someone may have some answers to these questions as we want to get everything in place to give the immigration next 3 weeks..

You can have all your documents copy certified in Oz at no charge at any police station, by any JP, at most court houses, Post Offices etc.

At time of application lodgment you should have the originals with you. If they want them, they'll retain them and return them to you later.

If you are not sharing any financial commitments at this time no need to worry. This aspect only adds strength to your assertion that the relationship is genuine.

You will need to prove that you are capable of financially supporting her and bub if a visa is granted.

If you are able to pay your debts to the Tax man and still be able to show that you have sufficient income to financially support your wife, that should be enough for the Oz Embassy/Immigration Dept.

Having a baby together strengthens your claim of a genuine relationship but it still does not assure you of visa success. You will still need to submit a strong application.

Your friend is probably applying for a Spouse Visa in Oz (as opposed to applying in LOS) and has been asked to pay a bond. The bond requirement is not always asked for. It is a decision made by the Oz case officer.

I hope someone may have some answers to these questions as we want to get everything in place to give the immigration next 3 weeks..

I think the answer to Q1 would be....yes, you can copy the docs and then take the copies to be certified, you will need to take the orginals with you to have the copies certified.

Q2...if you have been sending her money or can show that you have provided for her while you have been together then that should be enough...

Q5...you should only have to pay the lodgement fee and any other associated fees (VFS, Medical)

I take it you are applying for a de facto spouse visa....are you planning on her being in Oz when you apply, if so you may have problems.

One, she has to leave when the current visa expires unless she has been granted a further visa.

Two, she has to be in the country where she made the application for the visa to be granted.

Three, She may not be able to apply for a spouse visa while she is here on a tourist visa.

Good news is for the de facto visa that because you have the Bub, they may waive the 12 month living together requirement.
