Former Vice President Mike Pence has been subpoenaed by the special counsel overseeing probes into former President Donald Trump, according to multiple sources familiar with the matter.

It's not immediately clear what information the subpoena from special counsel Jack Smith is seeking, but it follows months of negotiations between federal prosecutors and Pence's legal team.

Smith was appointed in November to oversee the investigation into Trump's potential mishandling of classified documents after leaving the presidency and obstructing the government's efforts to retrieve them -- as well as a separate probe into efforts by Trump and his allies to overturn the results of the 2020 election.

BTW, this isn't about prosecuting Mike Pence for Insurrection. It's about informing the public about the details of the plot(s) to overthrow the election. I mean we all now why Pence wouldn't want to testify about his private, one-on-one conversations with Trump re: not certifying the election results...fear of Trump, tarnishing his presidential aspirations, igniting the MAGAmob. But maybe Pence should just do the "right" thing?

Mike Pence is preparing to resist a grand jury subpoena for testimony about former President Donald Trump’s push to overturn the 2020 election, according to two people familiar with the former vice president’s thinking.

 

Pence’s decision to challenge Special Counsel Jack Smith’s request has little to do with executive privilege, the people said. Rather, Pence is set to argue that his former role as president of the Senate — therefore a member of the legislative branch — shields him from certain Justice Department demands.

 

Pence allies say he is covered by the constitutional provision that protects congressional officials from legal proceedings related to their work — language known as the “speech or debate” clause. The clause, Pence allies say, legally binds federal prosecutors from compelling Pence to testify about the central components of Smith’s investigation. If Pence testifies, they say, it could jeopardize the separation of powers that the Constitution seeks to safeguard.

The US jurisdiction is just one big mess. Recommended for all would be criminals if they would like to do what they want - provided they can afford a bus load of good lawyers.

 

For me this system has completely lost face. What a shame for this wanna be world leader country.

Pence to fight subpoena from special counsel investigating Trump in January 6 investigation

Former Vice President Mike Pence is expected to fight a recent subpoena from the special counsel investigating former President Donald Trump’s post-2020 election activities based on the grounds that he was president of the Senate at the time and therefore shielded from the order, sources familiar with the matter tell CNN.

Pence is expected to address the subpoena and his response to it during a trip to Iowa on Wednesday, according to a source familiar with his plans. His decision to fight the subpoena comes as the former vice president is mulling a 2024 presidential bid.

Pence has been subpoenaed by Jack Smith, the special counsel investigating Trump and his role in January 6, 2021, a source familiar with the matter told CNN.

Hiding behind the Congressional speech and debate clause is the last refuge of this incompetent coward.

 

That said, what he experienced OUTSIDE of any role he might play in Congress, during his time as Trump's Vice-President would seem outside that scope.

Back when Dick Cheney was acting president and getting out of hand his team stated the VP was not part of the Legislative branch, nor the Executive branch.  I wasn't able to follow it closely, but I don't think anyone figured out how to rein him in. 

 

The thing I'll always remember Pence for is during the Covid epidemic, when asked why he didn't wear a mask, he said it was because he wanted to be able to look people eye.  Need it be pointed out the masks did not cover the eyes?  He should leave politics and go into the fertilizer business.

Well said.  It's rather amazing that Pence still thinks he has a shot at being POTUS in 2024.  While most everyone (not MAGA) admires him for doing his job on 6 Jan, the very people he needs to support him won't go near him.  Doesn't he realize that all the good he did in four years (read non-stop boot-licking) was wiped out on that day?  Trump will never forgive him, and neither will at least 30% of the GOP.

These two things can’t be simultaneously true:

 

1. Mike Pence has plans to run for POTUS.

 

2. Mike Pence isn’t going to take the opportunity to scupper Trump, who is ostensibly running for POTUS.

As much as I think he should testify, I think one of the main reasons is to somehow protect the Executive Branch.  It seems like all Presidents and VPs refuse to answer subpoenas and to testify unless forced to.

The special counsel investigating Donald Trump’s efforts to overturn the 2020 election issued a motion to compel testimony from Mike Pence in recent days – after the Trump legal team sought to block his appearance on executive privilege grounds, sources familiar with the matter said.

 

The compulsion motion against Pence marks a pre-emptive move by the special counsel to rebut the executive privilege arguments before Pence had even made an appearance before the federal grand jury in Washington DC pursuant to a subpoena issued last month, the sources said.

 

While Pence has suggested he would contest the subpoena, the Guardian has previously reported that is understood to involve him at least appearing before the grand jury and asserting the so-called speech or debate protection for congressional officials to specific questions.

A point of note.

 

Members of the Trump administration have managed to run the clock on subpoenas issues by Congressional committee investigations, in no small part because the courts are reluctant to compel people to appear before non Judicial hearings, preferring rather negotiated settlements.

 

This is not the case with criminal investigations under the DoJ in which the Courts do and have acted very swiftly to compel compliance to subpoenas.

 

Mike Pence will appear and he will give testimony, he’ll do so in short order.
