Two years after the enactment of the Prevention and Suppression of Torture and Enforced Disappearance Act in Thailand, challenges persist in ensuring comprehensive understanding and implementation among state officials. The Rights and Liberties Protection Department (RLPD) emphasizes the importance of law enforcement officers fully grasping both the law's text and its spirit.

 

Deputy RLPD Director-General Theerayuth Kaewsing highlighted at a recent workshop the need for greater awareness among officials to prevent abuses. The workshop, involving civil society, foundations, and media, stressed the necessity of clear operational protocols within government agencies.

 

Mr. Theerayuth underscored that these internal guidelines are crucial safeguards. Historical reports of torture, ill-treatment, and detention have eroded trust in Thailand's justice system, partly due to previous inefficiencies in prosecution and weak oversight.

 

Enacted in 2023, the Act signifies a major legal advancement by merging obligations from UN conventions on torture and enforced disappearance. It targets torture, cruel treatment, and enforced disappearance, aiming to strengthen investigations and ensure victim protection.

 

Despite these strides, implementation obstacles remain. Some incidents are still charged under lesser offences, reducing accountability and victim protection. Mr. Theerayuth noted that government agencies are directed to establish internal rules to align with the Act, reported Bangkok Post.
