  1. Child Under 20 (Minor)

    • Court Authorization: Section 1574 strictly requires Juvenile and Family Court approval for sales, mortgages, long-term leases (over 3 years), or encumbrances (usufructs/superficies).

    • Genuineness Check: The Land Office verifies that the transaction is a genuine gift to the child rather than an attempt to bypass foreign land-ownership prohibitions using a minor nominee.

  2. Child 20 or Older (Adult)

    • Holds full legal capacity to purchase and hold property directly without parental or judicial oversight.

If trying to keep the mother of child, hands off, then not going to work, as she'll be the kid's guardian, and ultimately, have control.

If even asking such a question ... rent or buy condo in your name, place in trust, then child can inherit condo when hits 20 yrs old, after you pass.

If a minor it would have to be in joint names of child and mother so as long as you trust the mother its doable.

I don't think it has to be in joint name, although the mother controls until child reaches age of consent. The mother can not sell, lease or rent out without a court order
