They said I should go out to the Kingdom so they can apply for it.As they said according to the labour department "the alien has not yet entered Thailand the employer should apply for the workpermit in his behalf". I told them I think they can apply eventhough I'm already here. But still they want me to go out to Laos, then have my passport stamp and send them a copy of my passport then they can apply for the WP3. This means I have to stay in Laos until the WP3 has been approved and only after that I can apply for a NOn-B visa in Laos as this is one of the requirement. If you are on a tourist visa you need to leave the country and apply for a Non-o visa, which can be used to apply for a work permit. Only for issue/work do you have to have the non immigrant visa. I am on a double entry TV and my last visa will expire on the 23rd after that I can apply for 1 month extension. So I was thingking better to go to Laos for a Non-B than to extend. But as I said the problem is one of the requirements in getting a Non-b is the WP3. But applying for a WP3 here the company said is very hard and I would need to be out of the Kingdom for them to apply. So this means I will stay in Laos and wait for the WP3 to be approve and then they can send me the WP3 and apply for the Non-B visa in Laos. But the company is teling me that when they first applied for the WP3 the foreigner is in Thailand but the labour dept. said the next time they will not allow this. monty Posted May 14, 2008 Share Posted May 14, 2008 As said many times, the way the labor department interprets the rules can differ from day to day, even from officer to officer! But in general it is indeed normal practice to apply for the work permit, obtain the WP3 form and then leave the country to go obtain a non immigrant visa (. This can be done while you are in the country regardless on what status (visa free 30 days or tourist). Anyway, the labor department wouldn't even know where you are, unless you fax copies of your passport showing the exit stamp after you arrive in Laos. I think the problem is that they don't really understand the rule regarding foreign employees. I even told them to submit only the photo page of the passport so they will not know that I am here. Anyways they said they will try to ask the labour dept. again as I'm tired of explaining to them that all of my friends who are working here doesn't have to go out only for their company to apply for a WP3. If you are in the Kingdom it does not matter for the WP3 at all. Only after the WP3 is approved do you have to leave the Kingdom to get the visa. We have done thousands of these WP3 cases and not once has this been an issue. By the way, in the past three months, all the cases that we have seen, Laos does not require a WP3( except with a natural employer.)
