Hi :o .

I've looked around this forum for answers to this, but have waded through the posts and threads for long enough now and also are ultimately unable to locate a sticky answering these following questions, so I'm going to ask everyone myself. I'm sure the answers are here somewhere and I probably need glasses, but anyhow here goes,

I'm the holder of a non-immigrant o visa which will expire in a week. I would like to go to Suan Phlu immigration department to extend it for a year based on the grounds of having a Thai wife and two rug-rats here in LoS.

Firstly, exactly what documentation and requirements will I need and have to meet at Suan Phlu?

Secondly, if I don't meet the extension criteria, what paperwork would I need to reapply for a multi-entry non-immigrant o visa at Penang, or Vientiane?

Thirdly. if I happened to be sponsored by a Thai business and scored a non-immigrant b visa at Penang, upon near expiration of this visa would I have any trouble extending it into a non-immigrant o visa at Suan Phlu, taking into consideration that I meet the requirements for an o visa of course.

1. You require proof of 40k per month family income to obtain one year extension of stay. Wife ID/Home Register/photos together/birth certificates/marriage certificate/passport/arrival card/copies of everything and current 4x6cm ID photo. Cost is 1,900 baht. Wife must be with you and sign paperwork/be interviewed.

2. Passport/ID photos/wife ID card copy/home register copy/marriage certificate/note from wife asking for visa issue and bank passbook showing some means of support. All may not be required but best to have and have wife sign/date copies of her documentation so they know you are still together. Not all get a multi entry at local Consulates but most seem to be able to currently.

3. You do not need a non immigrant B visa - you can work on the O visa.

If you are over 50 it would give you a couple of other options

Retirement or Living with your Thai Child.

As Lopburi said , for Marriage the main requirement is 40,000 Baht a month income. Yours, your Wifes or a combination of both.

Just say in the unlikely event that I did finish up with a non-im b in my passport whilst holidaying at Penang, iye, is it possible to transfer a 'b' to an 'o' at BKK immigration dept?

You do not change from B to O as there is no need - if you qualify for extension of stay for family you can do so from either visa entry.

Thanks pal, you've comprehensively given the details.

BTW, there's no certain time range needed to do the extension is there? I won't be told to exit the country like if I only have a certain number of days left on my visa, right?

Last 30 days of any entry on a non immigrant visa. If using visa exempt or tourist visa there is a 21 day remaining on stay requirement.

Hi Lop, just an additional question relating to this:

My income comes from abroad so doesn't pass through a Thai bank account, so will I have to produce original UK bank statements to the Brit Embassy to endorse first? If so, any approximate cost for this?

It is whatever the uk Embassy accepts.

Costs around 2.500 Baht.

Thought I would tag my question on to this thread, since spartacusman's question seems to be been wrapped up and the thread title fits.

I have a multiple entry Non-B visa. Just got married, so I am planning to apply for extension of stay based on marriage next month (a month before my Non-B expires). My first question is: is this possible? My legal advisor says it is, but it seems odd to me. I would have thought I needed to be on a Non-O visa, in order to apply for extension of stay based on marriage? (I don't meet the requirements for extension of my Non-B visa.)

Second question: concerning the requirement of a total income of at least 40,000 THB per month, I will submit my tax documents to show this (have WP and working in Thailand), but how far back does the requirement go? I seem to have something in my head about needing to show proof of this requirement for the year preceding the application, which is what my tax documents will show. If this is so, is the requirement a minimum of 40,000 per month for that year (which I don't meet), or an average of 40,000 per month (which I do meet)? Over the last 12 months, my salary has been (progressively) 5 x 35K, 6 x 40K, 1 x 80K. My legal advisor is talking about submitting an explanatory letter about my salary levels, which makes me think that the chances of my application succeeding are questionable. He says that in Bangkok this would not be a problem, but I am applying in Sri Racha, and he has no experience of that office.

In my view Immigration will accept that ( but they are a law unto themselves sometimes )

Thanks dr_Pat_Pong, I will just have to see how it goes. I have heard that the Sri Racha Immigration office is a friendly place. I will go and ask a few questions beforehand.

In answer to your questions

1) Yes that will be ok

2) As regards your 40,000 income the immigration will mainly want your Por Ngor Dor 91, which shows the total salary and tax paid for the previous year. eg 1 year income > 480,000, then all is ok. Different immigration departments do tend to have a different methods of determining salary, but your tax form should be enough for them. i.e in my experience they are looking for an average of 40,000 pcm.

Check note 5 in the required list of documents below:

1. Application Form.

2. Copy of the passport of the applicant.

3. Copy of the proof of relationship such as marriage evidences, birth certificate, certificate of child adoption registration, copy of census registration, certificate of adopted child adoption registration, or other papers issued by the related official organization or government agencies.

4. The evidences of having Thai nationality of the marriage couple, father, mother, ordinary child, or adopted child such as ID Card, census registration, or other papers issued by the related official organization or government agencies.

5. According to the Criterion No. 6, the applicant is required to attach the certificate of having the savings in the bank account of any Bank in Thailand and copy of the bank account, or evidences of personal income of either party or both that shows the total income of both parties not less than 40,000 Baht per month, such as the evidence of the personal income tax filing and the receipt, evidence of being a pensioner, credentials of receiving the interest of the saving money, or the evidences of having other income from other related organizations.

I've just re-read the instructions from my legal advisor - Por Ngor Dor 91 is filed annually in March, so it will show less than 480,000 for the year it covers. I will also be taking Por Ngor Dor 1's; guess I just need to take enough to fill in the details from March to present day. Still banking on the friendly reputation of the Sri Racha office.
