Sorry but this writers ideas defy logic.

They just confirm that some malfeasence took place

AFTER the court told Somchai what to do. He didn't.

This is 45 million baht in land tax not some trivial sum.

Or ar they trying to say the NCCC went to EASY on him...?

A new broom sweeps clean. Unfortunately there are NO clean new brooms among Thai veteran politicians. Do any of you who despise the PPP have any suggestions where to find an honest politician? They all belong to the good ole boy network regardless of party. You don't tell on me and I won't tell on you. Sad but true.

in answer to your question, yes, the author hates this goverment and would have like to have seen criminal charges brought against PM Somchai.

PM Somchai will face mandatory dismissal

Prime Minister Somchai Wongsawat committed serious malfeasance when he was the Permanent Secretary for the Justice Ministry in 1999, the National Counter Corruption Commission said yesterday.

Somchai would face mandatory dismissal under the anti-graft law of 1998 if the Justice Ministry's Civil Service Committee agrees with the NCCC after the commission forwards its report to the panel.

The dismissal would be made retroactive to the date of wrongdoing, but would not change Somchai's performance of his duties or his pay and benefits as a retired civil servant.

Somchai is entitled to appeal any disciplinary action to the ministry's committee and then to the Civil Service Commission, which has the final say in such matters. The commission has on several occasions before decided to withhold penalties in defiance of the NCCC.

Somchai refused to give interviews yesterday on the NCCC's ruling.

The crux of the disciplinary case against Somchai is his neglect in failing to penalise two senior officials from the Justice Ministry's Legal Execution Department.

Then director-general Pramarn Tiyapaiboonsin and his deputy Manit Suthaporn were found to have wrongfully waived a 5-per-cent fee on the auction of two plots worth Bt897 million as ordered by the Pathum Thani Provincial Court.

Under the ministry's chain of command, responsibility for Somchai's lapse of duty extends to then justice minister Suthas Ngernmuen and deputy permanent secretary Bandit Ratchatanan, who is now a senior judge.

The NCCC dropped disciplinary charges against Suthas since he was a political office-holder and subject to criminal law, not civil-service regulations.

It ruled to penalise Bandit and will forward his case to the Judiciary Commission for disciplinary action.

Justice Minister Somsak Kiartsuranont said he would appoint a panel to review the NCCC report before deciding the next move.

Somsak is the ex-officio chairman of disciplinary committees for justice officials.

He voiced scepticism on the merits and practicality of a retroactive dismissal for a retired official like Somchai.

Very topical update in light of Governor Apirak's resignation when implicated by the very same NCCC....

Justice Minister Somsak Kietsuranont says he has yet to receive suggestion about Somchai's current status after the National Counter Corruption Commission found him guilty of negligence in failing to investigate the corrupt auction of a land plot while serving as the Permanent-Secretary of the Justice Ministry.

P.S. Somchai was indicted by NCCC almost a month ago. Apirak was indicted 2 days ago and resigned the following day.

P.S.S. If Somchai needs further reason to resign, he can show responsibility, like he said he would.... and resign over an entirely different issue

Find that Somchai gave the order,

Find that Somchai could have, but didn't, change the venue for speach

Find they didn't HAVE to make it for 2 more days.

UPDATE... his PTP buddies tried to get him off... and failed...

Supreme Court rejects to review the NACC's ruling in the Somchai case

The Supreme Court on Thursday threw out a petition for the judicial review on the National Anti Corruption Commission for abuse of power in its graft ruling which triggered the downfall of former Prime Minister Somchai Wongsawat.

The high court said the petition, endorsed by 135 opposition lawmakers, did not merit the judicial intervention.

Pheu Thai Party MP Chaowarin Latthasaksiri spearheaded the petition after the NACC ruled that Somchai committed a serious disciplinary offence when he was Permanent Secretary for Justice.

Court Rejects Pheu Thai Party's Complaint aganist Anti-Graft Body

The Supreme Court has thrown out a complaint by the opposition Pheu Thai Party accusing the graft-fighting commission of abusing its power in pressing malfeasance charges against former prime minister Somchai Wongsawat.

The Supreme Court's division for cases against political post holders today rejected the complaint by Pheu Thai Party MPs accusing the National Anti-Corruption Commission, or NACC, of abuse of power for its pursuit of indictment against Somchai for malfeasance while he served as Permanent Secretary of the Justice Ministry.

The NACC's legal move followed Somchai's inaction against the Legal Execution Department Chief and his Deputy after they were found guilty of failing to collect a 70 million-baht fee for the sale of an impounded land plot in Pathum Thani's Thanyaburi District.

The court rejected Pheu Thai Party's complaint on the grounds that the anti-graft body legitimately acted within its authority in pursuing the legal action against Somchai.
