Some people say two months, some people says three months.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

It is 2 months, but if you can, you should keep it in for 3 months before applying. May save a lotta ranting and raving and getting nowhere with the ones who don't know their own laws!! :o

Pattaya Immigration demand 3 month, they obviously cant read their rule books.

It was 3 months previously, then they had a year of it not be available, except for those grandfathered, and now it is back at 2 months. A multitude of rules, that often change in the night.

In my interview at imm. yesterday they were happy that my 400K came from overseas. If it came from within Thailand I understand that they would have wanted to establish whether I had been working and if any tax was due on the money.

Each immigration office has its own rules. I still need a doctor's certificate for my extensions and that was canceled several years ago.

I'm going to say 3months. I went to ask this last week and the officer told me 2months. Then went back to see the same officer yesterday and she told me 3 months! It's crazy that they don't put ONE set of rules on a board at immigration and on the website, instead of different pieces of information that each person seems to have that is not consistent with existing information.

On top of that, if your income comes from investments or overseas income, it might not be possible to use the income option (despite what the rule says) unless you have a Thai work permit. Everyone at immigration seems to have their own interpretation of the regulations.
