Can Keep Its "visa" After Wp Canceled.

We had one guy here that have a permit of stay 365days based on work. We had to cancel his WP but felt that we wanted to help the guy with his visa. We sent our "visa specialist sectary" and him to immigration and got the information from a "high ranking officer" that he could still use his Permit of stay until it expires, no need for any changes even without the WP. This was totally new for me and i feel i need to listen if some one else here have heard anything like this before.

On the basis that he holds a 12 month extension of stay based on employment issued by Thai immigration (is not a visa), he has to leave the country on the day his employment ends, or go to immigration and obtain a 7 day extension. Otherwise he will be on overstay.

The only way he would be legally allowed to remain more than 7 days after the cancellation of his WP would be if he was on a non immigrant visa as opposed to an extension based upon his WP.

Agreed, if his original non-immigrant visa was multiple-entry and is still valid he can stay until it expires. He probably would need to leave the country and return to get a current 90 day permission to stay stamp. If on an extension of stay based on working, then sorry - no can do!

Not sure if this is the case here of course, but I have observed that people sometimes misunderstand when an extension of stay is based on WP.

Example:

Person is married to a Thai, extends stay by using the 40K domestic income, which requires to show the WP, but the extension is actually based on spouse. In such a case he can stay until the end of the current permit.

This guy have a Non Imm-B and got a extension of stay for one year. Our visa sectary though this was odd too but was ensured that it was no problems "as long as he kept him self out of trouble."

Yesterday i got the information that immigration does NOT run their databases together. So the border immigrant officer will not know that the WP have been cancelled and therefore not issue any overstay fine when he leaves the country.

But he is very likely to asked why he does not have a re-entry permit at the exit point, because without that he will loose his extension of stay, - then the web unravels and he has to return to his immigration office to pay fine and obtain a stamp in his passport from them before being allowed to exit the country. It just happened this week to another poster.

He is on overstay and has to leave the country. Right now he is illegaly staying in the country.

Immigration might ask him why he doesn't have a re-entry permit as when he leaves his permission to stay will end.

As said at some point he must leave the country as he no longer has a way to extend his stay - Immigration officers try to help people who have forgotten to obtain re-entry permits and will point this out to him - if they find out he is not employed they will likely ask when that employment ended and require he have a stamp indication of that end of employment in his passport prior to leaving. Will everyone be asked? I suspect not; but anyone being asked appears to be a recent thing.

Okay i get it. So he just have to apply for re-enter then.
