Potjaman sues FIDF for return of millions in Ratchadapisek land deal

BANGKOK, 26 November 2009 (NNT) - Potjaman na Pombejra, ex-wife of former Prime Minister Thaksin Shinawatra has lodged a counter lawsuit, demanding the Financial Institutions Development Fund to return millions for the purchase of Ratchadapisek land plots.

The counter lawsuit came after the FIDF earlier filed a lawsuit to reclaim the land as recommended by the Office of the Attorney General (OAG).

Ms Chatthip Tanthaprasas, Potjaman's lawyer, stated that the counter lawsuit was filed with the Civil Court on November 25 in attachement with Potjaman's defence statement against the FIDF, which seeks the court to invalidate the land purchase deals.

Ms Chatthip said her client lodged the counter lawsuit, demanding the FIDF to compensate the damages and return the 772 million baht previously paid for the 33-rai Ratchadapisek land.

According to the plaintiff's defence statement, the FIDF's lawsuit was deemed as unjustifiable since the land purchase was executed in compliance with the rules and regulations imposed by the FIDF after Potjaman eventually won the open bidding.

Citing the verdict earlier issued by the Supreme Court's Criminal Division for Holders of Political Positions against Thaksin, who was charged with breaching Section 100 and 122 of the National Anti-Corruption Act by granting permission to her for buying the controversial land.

The court did not rule that the land transaction was illegal and also did not order that the land or the money paid must be confiscated, claimed Potjaman, adding that the land purchase contract was to be nullified if indicating that such deal was conducted in an unlawful manner and caused damages.

According to the statement, the FIDF has already obtained an appropriate price in the open bidding.

The court is scheduled to deliberate the case on 21 December, 2008 and 25 January, 2009 at 13.30 hrs.
