I write for advice.

My wife, and I are intending to apply for a settlement visa for her this coming week. my wife is pregnant with our first child and is due to give birth on the 25th December. I must be with her for the birth and the following weeks, so I have had to resign my present contract as an electrical installer in order to be there with her.

I plan to return to the UK at the beginning of February and resume work, assuming I can obtain another contract, and Natchanok and our baby plan to join me here at the end of March, assuming you will issue her with a visa.

I should say that at no time will we be living on benefits, and we shall initially be living with my parents.

Please clarify if these circumstances will represent a problem in relation to a visa for my wife & child, as I am unclear as to the best path forwards.

Hi Terry

You should do a lot of research before you apply for UK Settlement Visa especially your accommodation. My wife has applied visa since June and got refusal notice in Sep and now we are in the process of appeal. The ECO failed us on accommodation. You should get some advice from the agency or read from the forum.

The house must be large enough to accommodate you all as per the rules do you have a room for your exclusive use ?

when you say the house must be large enough to accommodate us all pre the rules do i have a room for our exclusive use. does our bed room not count for that, our dose it have to be another room?

This maybe classed for your exclusive use please check the 1985 Housing act as a guide to overcrowded accommodation.

The accommodation can be shared with other family members and their dependants as long as they have a room for their exclusive use the unit maybe as small as a bedroom but ;

It must be owned or legally occupied by the sponsor.

It must not contravene public health regulations, and its occupation must not cause overcrowding as per 1985 housing act.

Any third party support must be short term only if family members intend to help support you.
