Is a legal Thai wife, married to a US citizen, subject to the same criteria as a non wife, in order to obtain a tourist visa. Do they presume she is a potential immigrant unless she has COMPELLING reasons to return to Thailand. She was turned down three times prior to marriage because she did not have large assets despite the fact that she is a 10 year registered nurse.

Not talking about a fiancée/ wife visa as we only need to stay a month in US.

Answer to your question YES. She has to show reasons of returning, connections to Thailand. Parents, siblings, children, property, business, job, bank account (no set amount). They do take into consideration your ability to support her hear and there. They do ask for or except a guarantor.

They do ask for or except a guarantor." What? Sure never heard of a ConOff asking for such, and indeed, a cash bond or similar is pretty meaningless vs the opportunity for some folks to get to the U.S. and not leave.

Scorpio, in answer to your Q, yes, I think the ConOffs actually do look for more "evidence" that a foreign wife is not just planning to jump the Q for getting a Green Card. That was pretty much the case with my Thai wife on her last Non-Immigrant Visa (NIV) interview.

She'd previously had a 10-year NIV before we were married. It expired so need another one for the occasional trip to the U.S. and back to Thailand. What I think made it easy for the ConOff to approve another NIV was my passport with its several years of retirement extensions of my Non-O Thai visa, my bank account here, a number of magazine subscriptions in my name delivered to our house, which of course is in her name. All pretty good evidence that I was established in Thailand and likely to return here, as would she.

So, Scorpio, if you're returning to Thailand, will probably be good to go for her NIV.

Being married makes the process much easier. The IO will be interested in her ties to YOU as much as her ties to Thailand. If you live here it is also a big plus. My wife was approved for 10 years on her first attempt back in January. We chose not to go the "marriage visa" route, because i am employed here and have no intention of returning to the US on a full time basis any time in the near future We just want to visit family. The IO did not even look at her finances, although my wife provided 5 bank books, nor was she interested in my finances. She is also a stay at home mom, so this is her "full time job". Remember every case is different.
