Hello,

the situation is as follows:

I am currently on a non-immigrant O visa based on marriage and have arrived in Thailand on August 16th 2010 from Penang, Malaysia.

I am fulfilling all the criteria for a 1 year extension(400k untouched in the bank for several months, wedding certificates etc.), I have done this many times before without problems, usually back to back without ever leaving at all.

From what I know about my case now, I can start applying for a 1 year extension only 60 days after I have entered the kingdom, that would mean around October 16th or so and not earlier.

In my experience, after applying, I will get my 1 year visa(or, in Thaivisa.com terms, extension of stay) back around 30 days later and not earlier.

Here comes the problem: I am going to HK for 1 week from November 8th until November 15th 2010.

If above rules apply, does it mean that I have to cancel my HK trip in order to get my 1 year extension done properly? After all, I will not be able to wait for 30 days after applying for the extension on October 16th.

What should I do?

Apply October and get a Re Entry Permit . This should work.

You will have to ask Immigration.

Some people have the same problem, usually it is not a problem if you get a re-entry permit and are back on time to get the rest of the 1 year extension.

So it'll be under review while I am gone basically and when I re-enter I will not have to wait 60 days again/get a new visa and all that ey but just go back there and get the stamp?

Yes, the 'under consideration' stamp date should be 30 days from the your current 90 day entry stamp 'permitted to stay' date.

You will have to be back in Thailand before the date you are due to next report back to immigration (the date on your 'under consideration stamp)'; this is also the date that your re-entry permit will perserve.
