Hi,

Say I have the Marriage Visa O, and me and the wife buy a townhouse, which is a combined residence and shop. If it is only my wife who takes care of the shop in the townhouse, will I be okay just using it for residence?

I believe you will be ok as long as you don't stay inside the area where the business take place or is clearly reserved to the business (like a stockroom, etc), keep in mind that just your presence in the business floor area can be seen as work (supervising, etc) and as a such prosecuted accordingly, however lets see what the experts have to say on the matter :)

Most of the shop-houses I have seen have the stairway to the upper floors at the back of the shop so the OP would have to traverse the shop to reach or exit his living quarters ... My suggestion would be to keep a selection of 5-baht snacks in the shop that the OP can purchase each time he is in on the shop floor so that -- should anyone inquire -- he is just a customer ... also keep a bunch of 5-baht coins in his pocket.

This would be the closest I could come to a definitive answer: Assuming there is more than one floor above the shop-house floor, rent the top-most floor yourself outright for more than 3 years such that the lease can be recorded at the land office with the lease stipulating that you are afforded access and egress to your floor via the the ground floor shop-house entrance.

I think the answer to this question is all about perceptions, you may not be actually working in the premises, but people could perceive you are.

There isnt anything saying you cant live in the townhouse
