Trial Period Before Work Permit

Featured Replies

Does anyone know if the Thai law allow a 3 month working time as a trial period before going for the work permit?

Thanks.

The answer is: no, it does not.

As said you would be working illegally.

Thanks,that's clear...

Many schools will not go through the work permit process until they are sure the teacher is going to stick around, technically you would be working illegally.

If the school is a goverment school, then the principal of the school is also a government employee as are immigration & the department of labour, so it would be down to who has the most clout, the most lightly outcome if the school was targeted would be the work permit application would need to submitted straight away, as long as you qualify for it and are not a wanted child molester, you would probably be ok.

The worst case scenaro is deported, but I seriously doubt this would happen.

I would not condone working in your situation, but this is generally how it is done in Thailand.

A three month trial period before application for a work permit is not allowed and would mean you are working illegally. While some Labor Department officers may allow you to work while the application is under consideration it is entirely up to their discretion. In cases where employers have ignored legal advice and started employees working while the application has been submitted but not yet approved, officers have called us to confirm that the application has in fact been submitted and allowed it but not all officers may do so and it can be considered illegal to work before the actual work permit has been issued.
