Hi, really need an answer to this question, my wife is in uk under eea rules, she has a valid residence stamp but its due to expire on march 2013. She has 2 boys back in thailand now who have no sole carer as her father recently passed away, she wants to return to thailand with me and our daughter. On return to uk say in five years time when her eea visa has expired will she be denied entry? Bear in mind our baby daughter was born here in uk and has uk passport. Can mother be seperated from daughter?

she is extremeley depressed and anxious about her two twin sons back in thailand, i cannot make visa as i have been recently made unemployed but we do have enough money in thai bank and 2 homes in thailand to enable us to go back and live for good few years hopefully.

The two children can join the Mother in the UK under EEA rules ?

Regulation 7 clearly states : that as the children are descendants of his spouse, they are entitled to apply for an EU family permit. The Mother if her visa expires cannot just board an aircraft without valid entry clearance she will need a visa of some sort.

Thanks for your reply but we, both of us are now unemployed, is it possible really for her two sons to join us:? We would love them to be with us now, also you are saying that if she were to go to the airport then the airline /immagration would not let her enter uk even though im with her and her baby is going back to uk. I dont know what sort of visa we could get if we are both unemployed.

As your wife has been living in Belfast since 2007, one has to wonder why you have not applied her sons to join you before now.

She cannot re-enter the UK if she has no valid entry clearance, they cannot enter the UK without a valid entry clearance.

As already stated by myself you can apply for EU Family permits now for her children.
