I left a job in March of last year and have been asked to join another company now but I am being told my WP was never cancelled from the previous company?

My visa was not tied to my WP when I left. 1)

The Managing Director told me they would take care of cancelling it 2)

I have a tax refund from the government that shows I paid no tax after March of last year. 3)

Am I wrong in all this???

Hi Dan,

WP can be canceled !!

and Your visa when you left company has nothing to do with WP.

By now your x-company may already cancelled your WP. You cannot know if they don't call or inform you because the company can do it without your signature.

However, the old WP will have to cancel when you apply for a new one. Check out on http://wp.doe.go.th/.../eng/index.html and link below is a form to apply for WP (TT1).

You may want to call them and ask further info if needed on tel: 02 245 2745 and 02 245 2306.

To apply for new work permit with new company, it has to start from scratch but of course the previous record including your tax refund may help a little.*

FYI: WP rule for a company "for every THB2M registration capital + 4 Thai employees can issue 1 WP". If the company revenue THB30M or more, they can renew work permit for their staff maximum 2 yrs period of time.

When you apply for new WP, you must obtain NON-B visa. New company will have to issue a letter for you to apply for a Non-B visa and will do the work permit for you too. This is because there are a lot of company documents to be submitted at Ministry of Labour -Office of Foreign Workers Administration, Dept. of Employment.

WP should have been cancelled.

For a new WP no need for a new NON-B visa, if the permission to stay is not based on working but for instance on being the family member of a Thai national.
