Obtain New Marriage Visa After Renouncing Citizenship?

Featured Replies

There are many reasons to renounce American citizenship, and almost no reason I can see to keep it. The only problem is, my marriage certificate has my US passport information and nationality clearly written on it. If I renounce, what happens?

Can I obtain a new marriage visa and subsequent extensions of stay by showing the passport of my new country and a copy of my old American passport with my certificate of loss of nationality? Or do I need to get my marriage documents updated somehow to reflect my new status?

Does anyone have any knowledge of how to proceed in this instance? Has anyone ever been in this situation?

...I would really rather stay on the topic of this forum however, which is visa regulations.

Does anyone have any information on how to obtain a marriage visa after changing your country of citizenship?

The single biggest problem in communication is the illusion that it has taken place

I think it is unlikely that any member reading this topic has been in the same situation. In your case, I would play it by ear. When applying for the non-O visa for the purpose of visiting your Thai wife, enclose a letter addressed to the consul explaining the different nationalities between your marriage certificate and your current passport and enclose a copy of the certificate of loss of US nationality.

Subsequently, when applying in Thailand for the one-year extension of stay for the reason of living with your Thai wife, do the same. It will make the job easier for the immigration office if you give the explanation in writing, not only verbally.

If you do follow through on your intention to renounce your US nationality, please be so kind as to come back to this topic later and report how it went with your applications for the visa and the extension of stay.

For an extension of stay based on having a Thai wife, you will have to register your marriage in Thailand.

Procedure is that you go to your embassy and have the marriage certificate legalised, then get a translation to thai of the document. This is then legalised at the Thai ministry of Foreign Affairs, Consular Department. When this is done, you go to any amphur in Thailand and have the marriage recorded into the Thai marriage register. Of this you get a khor rhor 22 form, which immigration requires to give an extension of stay and is proof of your marriage.

If you registered your marriage at an Amphoe here then it should not be any different than getting a new passport which has a different number than the one shown on your marriage certificate.

It also would be like using a different passport if you have dual nationality than the one that you used when you registered your marriage.

So can not see any reason for there being a problem for getting visas and/or extensions of stay.
