Affirmation Of Freedom To Marry Form (For Non 'o' Extension)

Featured Replies

I have noticed this little hurdle popping up more and more recently in the forum and am beginning to wonder if it really is required by law when applying for another yearly extension.

1. Currently, does Immigration at Chaeng Wattana ask for this form for a Non O extension?

2. If so, can the original or copy only be obtained from the Amphur where your marriage was registered or, as in the case of a Kor Ror 2 (updated marriage form), can it be obtained/printed out from any Amphur office?

You see, my problem is that I don't have a copy of my Affirmation of Freedom to Marry form issued by the British Embassy years ago, and if it is needed for my next extension, I may have to travel to the Amphur office in Chiang Rai (where our marriage was recorded and a Marriage Certificate issued) and I have been living in Bangkok for the past 10 years.

Any first-hand experiences at C/W in regards to this form would be greatly appreciated.

Many thanks

JD

Sorry cannot comment about Chaengwattana, but last year I was asked about this form, then this year the officer gave it back to me, my office is Nonthaburi, but as you are aware all my documents are sent to CW for approval.

Thanx Beano. I presume you presented a copy and not the original?

Yes I copied the original when I first received it, and used that, I also got my wife to get a new copy from the local Government office of the entry in the registrar, she got two, at Nonthaburi again they did not require it, just the old one, but they do know my wife and myself.

I believe BKK is not asking for it, but if so you can only present a copy of it.

The original will be at the amhur where you signed the wedding register and there you should obtain a copy. You cannot get a copy soemwhere else.

I never got a copy of it as I (stupidly) thought that once I got a marriage certificate, the Affirmation form was redundant. Never thought about Thai bureaucracy dry.png

Thanks for the feedback Mario, I was wondering what happened to my original, thought I'd lost it, but as you say its at the Amphur eh? I still have a copy and CW wanted to see it and kept it as I was applying for my extension a few weeks ago.

Thanks Digitalbanana, so C/W are starting to ask for it now?

Anyone else?

In the past their were reports that it was asked for when doing the first extension only and those were mostly for newly weds.

Thanx Joe.

I think a trip to Chiang Rai to get a copy of the form may still be on the cards as I don't want to rock up to C/W Immigration only to be told I need this form for my extension!!

Has anyone else (apart from Digitalbanana) been asked for this form at C/W recently?

We were also asked for this document, (first time application). Couldn't find it at home and the Amphur didn't have it. Found it at home eventually but the point is that they shouldn't be keeping document that belongs to you.

^^

Surely the Amphur keep the original on file and you keep copies (if any were made)? I didn't make a copy as I thought it would be no longer needed.

Thanx Cooked. I'm starting to wonder if I really need to make a trip to Chiang Rai to get a copy of the original as mabne it's only asked off newly weds or first time applicants.

Really don't know what to do at this stage!!

When I do my yearly extension besides taking my pension /finance detaisl and letter from the embassey I show a photocopy of my marriage certificate and 6 years on I have never had a problem !!!!!!!!!!! I am farang my wife is farang but we were married in Thailand so have the Thai wedding certificate !!!!! we got fed up always having to do 2 sets of everything !!!!!

That's a handy link, thanks. However, I wouldn't hold my breath waiting for a govt office to help me out!! Will try anyway.

I was on my 3rd extension last year and was asked for it, but this year she did not want it, but my office is Nonthaburi

They didn't ask for it directly, as I already had included it in my submission. My concern was it was a copy and not original (but as Mario pointed out I should no longer have original) , I just printed off a PDF file I had kept on computer. The CW official saw it and kept it without questioning its originality. Other stuff she didn't need was handed back.

Was it the English version from your embassy or the certified Thai translation from MFA?

I hope CW does not ask for this as a routine document, When we registered our marriage 43 years ago it was not in use or required by the Amphur.

Cuchulainn

My experience has shown that some amphur go out of thier way to help with documents. Takhli amphur actually placed some of my records in the computer system so I could get them at any Ket/amphur.

Thanks Asiaexpat, it may be worthwhile giving them a call then.

Any other experiences at CW for this form?

  • 10 months later...

yesterday I went for interview at CW and was asked for old Freedom to Marry certificate by immigration officer.

Slightly shocked, as i've been married 8 years. Been told to come back in 30 days to hear result of application, but I presume before then must try and get stamped copy from Amphur.

was also asked for copy of landlord's ID, which my wife said is not available, so she had to confirm that in writing on our lease agreement copy.

Was it your first extension?

If you have a 30 day under consideration stamp I would not worry about it. That means they have accepted your application. If they had been serious about wanting it they would not of accepted application and told you to get it and come back.

Yes, 2 months ago was my first application under the Marriage visa tied to working for a company. Previously I had always beaten the well-worn non immigrant B path as a teacher.

First they gave me 60 day extension in July, as they wanted proof of 2 months tax paid by my company - the visa company had only brought proof of 1 month's tax paid.

Your extension is not tied to your job. Your extension would still be valid if you got fired. It is only tied to you being married.

The 1st extension normally is the only time they ask the affirmation. Perhaps when they noticed that you had been married for 8 years they changed their minds.
