Hi,

Question 1

My wife is just coming up to 2yrs in the uk and we are looking to apply for ILR using SET M form.

The 2yrs have flown by and i have only just sat down and looked at the form.

I am short on letters jointly addressed to both of us .I have 2 council tax bills & 1 utility bill in both names.

She has plenty of of other letters addressed to herself (bank statements, doctor/hospital appoinments)

It dose say to provide these and explanation letter if you do not have the 6 jointly named.

I would say this is because all the house/utilty bills were already in my name before she arrived,we have a young son together.

so she has not worked and could not contriubute towards them so there was no point putting her name on them.

Has any one else been in a similar situation was it ok.

Question 2

We were allready married when she entered the UK.

Do you need to supply your marriage certificate & certififed copy in english (which we do not have).

It reads to me like like you only need to supply this if you were unmarried when she entered the uk.

All her friends are telling her you need it.

If you do, dose any one no where i could get a certified copy translated in the uk.

It shows marriage certificate on check list but the check list looks a bit like a generic one to me.

It would be intrested to here if people have applyed with out sending a copy of certificate,and was it ok

Any help on the above would be very greatfull.

Q1,

Chase up the missing utility bills and thus proof that you are still together,spanning the 2 years.

Why give them the chance of coming back to you with queries,which you know about already?

Footnote: Don't take no for an answer,these Utility companies can produce dated bills,even though they say:"can't do,we only send out bills 2 x a year".

Q2.

Yes you do need to enclose your Marriage Certificate with a Certified English Translation,(But surely you needed the Marriage Certificate Translation for the "Settlement Visa"???

I'm sure you can find out on the Internet your local Translation Service,or ask at your local C A B.

The key is: make it easy for the Officer that deals with your application,and the only contact you will have with the UKBA is that all important ILR sticker in your Partners Passport.

I take it you are dealing with this application yourself,and I know it seems quite daunting at times,but believe me you will be a very happy man and rightly proud of yourself,when your wifes ILR comes back sucessful,which I am sure it will do.

Thanks for the reply Majic,

I proberley did not make it clear,I only added her to the council tax bill when she arrived ,i did not add her to utiliy bills.

I only recently added her to water bill before christmas when i started looking into this.

Yes, we would have had a copy of the translated marriage certificate,but she did not bring it to the Uk,

and her family cannot find it.

Her visa runs until 01/04/13 so we have a bit of time to sort out .

I think i will give C A B a look

A mixture of letters addressed to you jointly, her individually and you individually is fine; as long as they cover the whole two years.

Read Form SET(M) section 11B Spouses and Civil Partners.

You will see that it says you only need to submit your marriage certificate if the current visa/leave to remain is as an unmarried partner or same sex partner and you have since married/registered a civil partnership.

If you are applying as a spouse civil partner but your existing leave to enter or remain in the UK was granted as an

unmarried or same-sex partner, in addition to the relevant documents in 11A you must provide the following

documents...........

So, if her current visa/leave to remain is as a spouse then your marriage certificate is not required.

For the reply,

I have now found 2 more jointly named letters so i have 5 now so i am not worried about this point now.

Am going to use the checking service at the local county council for peace of mind.

If you have documents missing they give you 7 days to sort out.

She dose have a spouse visa now,buti am yet to find anyone who has not sent in application without translated marriage certificate.

I am going to try without ,noing i can get this done if needed within the 7 days.
