Hi I need urgent advice please.

I have a 1 Year Non Immigrant B Visa (extension) where I check in with Phuket Immigration every 90 days.

Last year, mid Oct it expired and the extension application was submitted to my accountant here in Phuket at the end of September!

My visa extension still has not been granted, although my accountant tells me that this is not a problem and I have to wait :-(

I check in with him every day and still there is no news!

I'm still waiting and I'm very worried.

My WP expires 6 Feb 2013!

Any ideas on how can proceed, what's the best route?

Should I get my passport back and then try and get another 1 Yr Non B Visa somewhere else?

But which countries are issuing now?

Please help I really don't know what to do.

Work permit expiration is not always the expiration date of extension of stay so you should be concerned with that rather than the February expiration of work permit if not the same. But do not believe any Consulate (surly none in the area) would currently issue you a multi entry B visa for work with an expiring work permit so you should be extending as you appear to be doing.

With you WP expiring next month, I guess you can only get a single non-B visa in the region.

I can't inmagine why an extension should take so long. Did you contact immirgaiton about this yourself.

If your accountant has not received your extension you may be on overstay. You should not be waiting for anything. Demand to have your passport back and to know whether the extension has been granted. Personally I do not give my passport to employers for anything.

Hmmm, I'd be concerned about your "permitted to stay" period. What does the STAMP in your passport indicate?

Did Immigration stamp it with something like: "Under Consideration, until xxxx"?

My visa extension ran out in mid Oct 2012.

My accountant said that they have submitted the paperwork and I just have to wait!

They also mentioned that they have 30+ passports that are waiting too!?

There is nothing n my passport that specifies "Under Consideration, until xxx" unfortunately :-(

Where is your passport? You need to have at all times and you need to have an entry in that passport allowing your stay (even when under review such a stamp is placed in your passport and passport returned to you). You are employed with a real job rather than using a visa service/front type company? This is sounding very strange.

A non O extension based on marriage takes 30 days, so I would assume that it would be the same for a Non B Extension.

I called into my accountant and got my passport back, he will refund me the money that I paid back in Sep for the extension!

Now I am left with overstay and to set up another company & WP, lesson learned!

Now all you need to do is get him to pay you whatever your overstay fine is going to be, since he knowingly knew you were on overstay while he held your passport.

Overstay is 500 Baht a day up to a maximum of 20,000 Baht

Overstay will be 20,000 bhat since it has been well over 40 days which equals the max fine.
