My wife will have to apply for her iLR visa (or maybe FLR) on the 3rd October 2013. She has taken an ESOL speaking and listening course, with citizenship, entry level 3 in preparation for the proposed changes that are coming into effect in October 2013 ( which requires you to have a life in UK test pass and B1 pass in speaking and listening before applying for iLR ).

The UKBA have now announced these changes will be coming into effect on the 28th october 2013. I just found this out today.

I phoned the college and they said the course my wife did was with citizenship and this would be enough under the current visa requirements.

She was assessed at entry level 3 and did the exam, which gives her a pass at entry level 3.

my concern is, i think my wife has to demonstrate her language skill has improved, ie from a entry level 2 to 3. and she has not done this. The college said they could provide me with a letter saying she completed the course.

So will this be accepted by the UKBA?

If not, can she take another ESOL course with citizenship before October? But at what level would this be? level 1? ( which is higher than entry level 3)

any help is welcome

To demonstrate 'relevant progress', her college must confirm that she has progressed by at least 1 level from the level at which she was assessed at the beginning of the course that led to her relevant qualification. For example, if she was initially assessed as being below Entry 1 level, she must obtain a relevant ESOL qualification at Entry 1 level or above.

If the college will do this, fine; she meets the requirement.


But if they are not prepared to confirm this then she will not meet the requirement.


In which case, she has two options:
■Take another course in which she will progress a level; if she can do this in time; or
■Take the LitUK test; as her ability is at ESOL entry level 3 then she should be capable of understanding the study materials and passing the test.

If she is unable to do either then I'm afraid her only option will be to apply for FLR; for which her current qualification is more than sufficient.

i spoke to my wife's tutor this morning. he said he assessed her on the first day of the course at entry level 3 emerging. when she passed she would be an entry level 3 established. in his opinion this does show progression.

my wife did go in for an initial assessment 1 month before the course started. i was with her, and the lady ( a different person ) said her tenses were not good enough for entry level 3 but that my wife could start the course and the tutor will assess her when she goes.

The tutor will ask the lady tomorrow about this initial assessment. he says that she could well have been initially assessed at entry 2 established or consolidated. if so, this can be recorded on the college letter to the ukba. i think things are looking promising.
