Just had the wife's son visa refused on the crowds that we did not put info about him school, who looks after him and where he stays in Thailand

To answer the questions he has finished school he is 17, he lives in our house with his sister who is 19 and his cousin and her husband live next door

So what are the next steps can we appeal or is it best to do the visa again with all the correct info

We now have paper to say that he has finished school and id card copies and blue house book copies of the family next door

You don't say to which country you applied to visit but if it is the UK then you are unable to appeal the decision you can apply again as soon as you wish and supply the documents that they require, you could phone the embassy and ask about submitting the required documents but I am unsure how successful that would be.

I am appealing a refusal for a UK visa at the moment. I have a thread ruuning abount additional documents that I should get mu wife to supply when she goes back to Thailand on holiday. The reason for rejection for my wife's son are different to yours.

I am appealing the rejection and the legal firm dealing with it suggest that I get the following:

Any letters from school and any medical letters or bills concerning XXXXXXX addressed to your wife

Evidence of where the child is living and who with for the last 2 years i.e utility bills, reference letters, pictures

Evidence of where his father lives – if known

Just wondering why you would jeopardize the visa for not including such vital information?

I've got a feeling your not from Australia. I've noticed vfs case officers ring their cases and request further info before final decisions.

You applied for just a visit visa (tourist or family visit)? did you apply before 25th June? if after that date then you are unable to appeal http://www.ukba.homeoffice.gov.uk/sitecontent/newsarticles/2013/june/71-appeals-family.

Even if before then it does seem an expensive way, would it not be more cost effective to just apply again supplying the documents that they require then should should be almost guaranteed to have your visa granted.

We had not contact from the ECO requesting further info what I thought was strange as when the wife done her settlement visa we had a email asking for upto date payslips

I can't believe that want to know where him live or who take care him they think she leave him sleep on the road alone

I can't believe you do not understand why they want to know where he lives,goes to school and who takes care of him.

You say you will leave it for a few months. Once he reaches 18 he'll be in the adult dependant relative category.

If your stepdaughter is 19 she is no longer a child so you'll be looking at an adult dependant relative visa for her as well.

You've got a bit of footwork ahead of you.

Have you thought about what they will do when they arrive in terms of work or schooling. It's very difficult for kids born in the UK without decent qualifications to get work let alone a non English speaking teenager.

I don't think the ECO will be interested in the family next door and their details.

I'm sure others will shoot me down in flames but it appears both are fairly self sufficient.

Mr Sata, once again you are way off the mark.

The OP is asking about a visit; not settlement.

The adult dependant relative rules do not come into it; they are for settlement.

They want the information to show that the boy has reasons to return to Thailand and is not using a visit visa to by pass the settlement rules and remain in the UK with his mother once here.

For example, when my step-son visited us for the first time he had just started university and we provided evidence of his attendance there and a letter from one of his tutors confirming when he had to return.

As well as providing evidence on why he will return to Thailand, you should also in your sponsor's letter explain why he does not wish to live in the UK with his mother.

From what he has stated I can't see the sort of ties with Thailand that will suggest he will convince an ECO of a desire to return.

A family visit visa is still a visit visa and the applicant still needs to demonstrate a reason to return.
