Getting new non B for new work permit on day old one expires

Featured Replies

I was hoping someone with experience with this in the past could help me out:

I am changing jobs and, because of the change in position as well, have been told I need a new work permit. My ending of work with my past employer is amicable, so based on recommendations from experienced persons, I'm supposed to terminate employment at the first job one or two days before my extension of stay and work permit expire.

I'm flying out of the country that afternoon to apply for a single entry non-B in Kuala Lumpur. My question is, if I apply the day before my old work permit/extension of stay expires, will it impact my chances at all? Will the visa date be the day I applied, or the following day when I receive the visa?

I'm mostly curious because a) the expiry date is a Friday so applying or receiving on that day amounts to very different plans for me, and B) there's evidently some benefit to applying for a fresh visa after the old work permit expires, and I don't want to ruin that.

Thanks.

Apparently you do not have a valid visa just an extension of stay that you will be cancelling before you leave.

So you will have no problem getting a new visa.

Sorry, I've been reading a lot consequently thought one thing while wrote another. My visa is a full valid non-imm B still within its initial valid until date.

If you have a single entry non-B visa and are still within the first 90 days of entry you best terminate the work permit if your employment ends before the date the work permit expires. You simply fill in a form at the labour office. That should ensure no problems when you next apply for a work permit.

You can than just leave the country and get a new non-B visa abroad with all required paperwork, which might include a WP3 for from the labour office showing you have applied for a work permit for the new job. (For teachers this is normally not required, but for others it often is).

No problems regarding the old visa.

if you have a valid multiple non-B visa, you can simply leave Thailand and enter again for another 90 days. No need to apply for a new visa.

Thanks a lot for the answers. Do I need to worry about the labor office form if the old WP expires?

Right now I have a WP I've had for 2 years (first + renewal--they changed the booklet to a new version for this).

Here's my proposed timeline (sorry, should have included from the get go):

Day X: Submit visa application for single-entry non B

Day X+1: Pick up visa. This is the day the old visa and the work permit I had before were scheduled to expire.

Is it ok to start again on the old good thru day? Does it count as broken up or do I need to suck it up and submit on the second day and pick up the monday following?

Is all of the paperwork listed on the page for non-imm B required for the 90 day single entry version? I was told I needed the new non-B before I could get the WP3 receipt? Is that right or do I need to work on getting that this week?

Thanks again for the help. Apologies for following my question with more questions.

You must have a WP3 to get a non- b visa at any nearby location unless you are a teacher.

You will not be able to apply for a new work permit until old one is cancelled.

In your OP you stated you have an extension of stay which is not a visa. Have you been making border runs every 90 days or reports to immigration? Reports to immigration would be an extension.

An extension must be cancelled also.

No, no runs or immigrations activities since getting the visa last October. Thanks for the help.

You may have a very costly surprise when you leave the country. The only visa you could possibly have is a multiple entry visa that only gives 90 day entries. So you may have to pay a 20,000 baht overstay fine when you leave.

I have had a non-imm B that required the 90 day checks at immigration. I had the same visa for the last two years, it was renewed a year ago. I've gone abroad 3 times for work over that time, going in and out of immigration on that visa )and re-entry permit) each time.

So you do have an extension of stay not a visa.

A visa only allows you to enter the country on entry you are given permit to stay date meaning you no longer have a visa you have a permit to stay.
