The rules require an applicant to have been physically present in the UK 3/5 years previously on the day after the application is received.

If they were left the UK on that specific day would they still qualify by being present for only a part of the day ?

Having asked the question recently of the UKBA I was advised that you have to be in the country for a full 24 hours for it to be a qualifying day. So my understanding of the answer to your question is NO.

Did they give you that advice in writing or refer to any written guidance / interpretation documents ?

It would appear to contradict their method of calculating days absent where day of departure and arrival back in UK is not counted as days absent from UK.

The information was given verbally on the telephone by one of the UKBA operatives, maybe you need to call them at the Croydon Contact Centre and ask for the rules in writing. 0870 606 7766.
