Hi, my name is Chris Blackwell and I am married to a thai women. We have two children together, a 2 year old boy and a 1 month old girl and have been married for 2 years. I would like to acquire a visa for her to stay in the uk for 6 months. I am working full time on minimum wage. I am currently in thailand and will return with my son who has both passports. When I return with my son I will reduce my hours to 22 a week. I will eventually claim benefits for a while as a single parent. My wife has been to the uk before but we had 10k in the bank and promise of a job on entering the uk for myself. Now the circumstances have changed. I have 1k in the bank and at this time a full time job in the uk. How should I proceed? I also have a grandad who has 50k + in the bank and is willing to sponser my wife. Is this possible with claiming benefits? I have just been to the birtish embassy for my daughter's passport which will take about 6 weeks to receive.

Affordability could be a barrier but if another family member is willing to sponsor that may not be a problem.

The biggest problem I see is your wife needs to show adequate reasons to return to Thailand. From the limited information it may be a very big obstacle to overcome.

Everything you say is likely to ring every warning bell for the Entry Clearance Officer that this may be an attempt to bypass the settlement rules. A six month visit suggests your wife does not work. It is a long visit!

When we applied the first time we didn't mention anything about returning to the uk. Just that she would be come for a family holiday visit. I couldn't upload as a file so below is what I sent last time, which was satisfactory.

Dear Sir/ Madam,

I am Mr Christopher…, holder of British Passport No… and resident of the above address.

I wish to sponsor my Wife Narissaraporn for a general holiday visa to the United Kingdom.

I first met Narissaraporn in October 2010 through a friend, after being together for 11 months we had a son together on the 24th September 2011. His name is Alexander… and he is nine months old. We got married on the 17th October 2011 and have been living together in Bangkok ever since. I have enclosed photographs and the original wedding certificate.

My history of Thailand is I first came for a holiday in May 2010 and quickly realised how much I love this country and chose to come back and spend as much time as possible here. So I came back in September 2010 and stayed for a longer holiday; however I hadn’t finished my degree so four months after I met Narissaraporn I went back to the UK to finish my exams that I needed to pass in January. When I passed I achieved my Bachelors Degree and was ready to come back to Thailand where I stayed with Narissaraporn in May 2011. In June 2011, I found work at Patai Udom Suksa School where I was given a contract to become an English teacher for one year. Since then we have been living at the same rented town house with my son and wife in Bangkok. However, we will be moving to stay in Chonburi at the end of the month because my contract at Patai has finished and I will be returning back to the UK in two weeks time. I am also currently in the process of getting my son a British Passport. I have enclosed my work visa, rented town house contract and degree certificate.

My mother has deposited 8000 pounds into my account to help with air flights. I have enclosed my 6 months bank statements to show this. However, due to living and working in Thailand for 1 year I haven’t used my bank account recently. I have been earning gross 32,000 baht each month, which I put into my wife’s bank account. I have enclosed my wife’s 6 month bank statement and a written letter from the school that I worked at.

The main reason I want Narissaraporn to come to England with me is that I have been offered a job with Ray McGough as an Electrical Engineering assistant; I have accepted this position until I find a job in my chosen career as a Civil Engineer. Enclosed is evidence of my offer of employment.

I would miss my son and wife dreadfully if I have to return to England alone. She is an honest caring mother whom I love very dearly. Since living in Bangkok we have made many friends together, I have enclosed one reference from our dearest friend Narong… , in a hope to prove to you that we are a genuine couple. When we go to England we will be staying at… . This house belongs to my Mother, Karen and she has written a letter expressing her willingness and hope that we stay with her for the whole holiday.

I would also like Narissaraporn to meet my family especially my father. My mother has visited Thailand and approves of my marriage to Narissaraporn. She is a nurse in the UK and is married to a Thai Husband, where they have been together for about 2 years and 6 months. Our long term plan is to find a house in either Thailand or England where I can work and take care of my family for our future.

Enclosed documents are:

  3. Reference letter from a dearest friend
  4. Work reference guaranteeing me work
  5. Passport details, from myself and Narissaraporn

I believe this was our way of getting a visa. 'Even if there is no 'concrete' reason to return, many people have obtained a UK visit visa based upon the strength of their relationship with their sponsor. If the ECO believes the relationship to be genuine then they will also believe that the applicant would not want to jeopardise future applications, such as settlement, by overstaying or otherwise breaching the conditions of a visit visa'.

Upload your new letter.

I am suprised they issued a visa from reading your last letter; It lacks maturity and reads like a soap apera plot.

Your first child was conceived 3 months into the relationship to a previously married lady. Is she a lot older than you? Does she have kids from the last marriage?

Why would she return to Thailand if you and the kids are in England?

This is what the VFC wants to know.

Your financial position has changed significantly and this could affect the way the ECO views the application. Most of us are completely honest and straight forward in our dealings with authority but plenty are not!

I have no idea if the visa is likely to be granted or not. Your post reads that you were living together in Thailand now living in different countries. This could change things significantly.

The ECO's must be watching carefully for people trying to circumvent the new financial rules! You must address reasons to return very thoroughly. Your wife will be returning to Thailand without her son at the end of the six months stay if she is to comply with the visa requirements. Her husband and older child will be resident in the UK. She must demonstrate that she will go back to Thailand.

Sorry playing devils advocate and not trying to be unconstructive but this is how an ECO may view the application.

IMO the original letter was fine (it resulted in a visa being issued after all). Age differences real or imagined are none of our (or ECO's) business.

To the best of my knowledge it is the States and Canada who are big on Thai's having asa reason to return to Thailand. I know of one lady who tried it based on the fact she had kids here, The States said no and Canada is even harder.

why not go and start working and work on the visa from that end. If you are working it will give you a stronger position than saying I have been promised a job.

We have decide I will go back alone to the minimum wage job and process the visa when i am in the uk, 4 weeks into the british passport being done. I will go through the same method as before but with my grandad sponsering her. I feel confident this will suffice because she returned the last time and she will return again as we want a settlement visa later on. Also, I have read that the courts are deciding if to reduce the amount of annual income to around 13000 pound. fingers crossed.

The illogical idiocy, is that governments forceably separate families, giving member no choice but to go on the dole.

A married couple, with their children should be allowed to live together in either parent's country.
