Thai Mother of European Citizenship Child, transit in EU without visa, can be expulsed ?

I would like to know, what can happened if a Mother, Thai of nationality, transit in EU, ( with ownard ticket, to other non-Schengen visa and decide don't use it ), but decide by force to trying pass Immigration Passport Control, and pretend with all the paper, she's a mother of EU child, and asking to pass the border, what can happened to the mother ? She will show her Thai passport, & the EU passport of the kid, with all birth certificate and proof relationship. How the authorities will decide ?

They will give really a visa, or let her outside the airport to her ?

The first hurdle would be to get to the boarder, I assume you mean fly to a EU country in which case they would almost certainly be "denied boarding" as the carrier would almost certainly be fined and have to repatriate them at their expense if the turned up at an EU airport without correct Visa.

A parent is a qualifying family member under the EEA freedom of movement rules so, as your quote says, if she can show that she is the parent of an EEA national and she is travelling with or to join the child then under the regulations she should be allowed entry into the Schengen area, indeed into any EEA state other than the one of which the child is a citizen.

But I would recommend getting a visa in advance as this will save delays at immigration while she proves this, and as Basil says the airline may refuse to carry her without one. As a qualifying family member the visa should be quick and easy to obtain and free.

I am perturbed, though, by your wording of the question.

Attempting to use force to pass through immigration can lead to just one result; arrest and being sent back home at best, possibly imprisonment as well. The same for pretending to be the mother of an EU citizen in order to gain entry.

If this is poor wording on your part and all is above board, I have to wonder why she would buy a ticket to a final destination outside the Schengen area and have a visa for that destination.

Why not simply obtain a Schengen visa in advance and a ticket for her real destination?

This will certainly be something immigration will want to know when she attempts to enter the Schengen area without a visa.

This sounds to me like another of those domestic situations where the partner has taken the child and the OP is annoyed.

If she has the correct paperwork she'll be allowed to check in and if she does not she'll be refused.
