EC seeks talks with PM on new voting

BANGKOK: -- The Election Commission plans by tomorrow at the latest to send its letter to Prime Minister Yingluck Shinawatra inviting her to discuss a new date for voting in the 28 southern constituencies that had no candidates in the February 2 election.

Puchong Nutrawong, secretary-general of the EC, said yesterday that the decision on the letter was made at an EC meeting that resolved to recommend to the government that it issue a royal decree to establish a new polling date.

Pheu Thai Party spokesman Prompong Nopparit said that

proposal by the EC was just a ploy to trap the caretaker government.

It would pave the way for the voiding of the February 2 election and for the Democrat Party to take the caretaker Cabinet to court, which would lead to the dissolution of Pheu Thai, Prompong said.

Prompong said the Supreme Court's Election Division has already ruled that the EC has the authority to manage and oversee the election, so the EC and not the government has the duty to conduct an election for the 28 constituencies.

The EC should not resort to gimmicks to buy time, nor try to pass on its responsibility to the government, he said.

Democrat spokesman Chavanond Intarakomalyasut said Thai politics have reached an impasse, as Pheu Thai has rejected the EC's proposal.

The EC should now petition the Constitutional Court under Article 241 of the charter asking it to clarify the matter, he said.

The government and the EC should not just simply say they do not have the power to stage a new poll, but act immediately to solve the problem, he added.

Don't do anything, Madam PM. Several posters on this forum have stated that the EC is setting a trap for you. Just hole up and wait; maybe it will go away. It has worked before because people in Thailand have a short political memory and are distracted by new events. My advise to you, Madam PM is to just lay low and hope for the best; not that you have a lot of choices left anyway.

Exactly and how many times have we seen ' meetings ' and ' discussions ' amount to nothing more than a game of Pass The Parcel ?

The Constitutional Court seems to the court of last resort unless of course they find against the government in which case they are simply ignored.

While you mean to be sarcastic in your comments, "holing" up is just what the PTP needs to do. EC cannot escape its reponsibility to assure the elections are complete and trying to pass it off to the Court or the administration should be grounds to dissolve the EC...if there is such a process. EC has repeatedly shown it will no follow any process that aides the government in completeing the elections, even in accordance with the Constitution. Thai's do seem to have long memories and can remember the circumstances that led to the undemocratic overthrow of their election PM and parliament. And they have not yet forgotten Suthep's repeated calls for an unelected "shadow" government whose reforms will disenfranchise people's right to vote.

Exactly and how many times have we seen ' meetings ' and ' discussions ' amount to nothing more than a game of Pass The Parcel ?

The Constitutional Court seems to the court of last resort unless of course they find against the government in which case they are simply ignored.

Have you ever heard about someone who disagrees with the law or a court ruling but still abides by it? It's called freedom of speech. You and anti-Thaksin people keep harping about the Administration ignoring the Court's decision but what has the Administration actually done contrary to the Court's decisions? Answer: nothing. Though I have suspicions about a court established by the Democrat government that came to power through a coup would be able to provide any fair judgement towards the PTP administration elected by voters.

Indeed, the Constitutional Court will need to weigh in on this, as the Yingluck administration continues to need to be baby-fed through this whole process. The Constitutional Court advised the administration to work with the EC. But not only does Pheu Thai refuse to do that, they now are claiming the EC is out to trap them. How can things constitutionally proceed when a constitutionally empowered institution is not adhered to as it's been directed, and is in fact the object of conspiracy allegations ? What we have is paralysis, an inability to effectively govern, work with others, talk to others, reach consensus. Pheu Thai is now engaged in a kind of hissy fit. They won't come out and play. So there.

Whoever thinks the EC needs to be dissolved is in cloud cuckoo land.

The EC are being stopped at every turn by the Gov. The gov won't even talk to them any more. They are ultra paranoid, and have left the EC with no alternative than to seek a constitutional ruling on the subject and the gov will HAVE TO go along with that ruling. They have put themselves in this position and nobody else.

What is likely is the the CC will allow the new decree to be requested, and if that happens, then of course the gov can't be held responsible later in law. So why are they so worried? This is a case of the CC cutting them some slack if anything.

There is no need to be paranoid, because they are already in the process of being dissolved on a bunch of other cases.

Why do you think there was an emergency meeting held yesterday in Myanmar with Thaksin, PTP ministers and high ranking police, (and probably Yingluck would have secretly been there too)???

Something is about to happen, I am waiting patiently to see what it is. But chances are it will be some form of desperate measure if I know this bunch of criminals it won't be pleasant... We may even see some assassinations come out of it.

The Constitutional court was established in 1997.

Very presumptuous of you to suggest I am ant-Thaksin because I dare to make a comment you don't like.

How very red and PTP. I'm no fan of either side in this mess but am entitled to my opinion on this great open forum or does that not suit ?
