Maybe I'm not connecting the dots here? or do you mean it's an assumption that TVF members would be behind bars? of course it is an assumption, as the defamation laws are stupid, that's the point. It's like trying to sue MacDonalds for being fat after you've eaten 3 1/4 pounders with cheese, 2 fries, and 2 larges cokes to go.!! The reference to people in glass houses isn't an assumption either, as all one needs to do is look at the anti Thaksin group and the anti Suthep group, and see that there's a group of individuals on both sides who use terms like "terrorist", "fascist", "Thug". "murderer" who in my opinion are openly defaming Abhisit, Suthep and Thaksin,amongst many others, calling people murderers, and terrorists who haven't been convicted is a defamation, and I'm very surprised that TVF doesn't clamp down on it, but then again, the posts wouldn't be so "entertaining". Anyway, it's all moot, Jutaporn isn't in Prison, the laws of the land and the courts decided that, and it seems to gall some of the members that he's not behind bars. The court in this instance didn't see the need for a custodial sentence.. get over it, as I'm sure there will be other opportunities arising for that!!! whybother Posted May 22, 2014 Share Posted May 22, 2014 As is clearly shown by the recent actions by the Thai Navy against two reporters at Phuket Wan newspaper and reporters at Reuters over their stories that alleged Thai Navy involvement in the trafficking of Rohingya, defamation suits are used to stifle dissent and the views of political opponents. Yes, there are many countries that have such statutes on the books but they are used for the same reason. In Thailand, the use of libel and defamation suits has gotten completely out of hand. It is my understanding that a person who is charged with defamation or libel must be able to show that his/her remarks were the truth and that the remarks were made in the public interest. Since the murder charges are still pending against Abhisit, we still don't know whether the remarks he made have a basis in truth or not. The allegations made against Abhisit involve abuse of power and are certainly in the public interest. Politicians and public officials in Thailand and many other countries in the world just need thicker skin instead of running off to court all the time. It comes with the turf. The current case against Abhisit isn't about whether he "ordered the army to kill red shirts". So the result of the case wouldn't prove that one way or the other. If Jatuporn can't prove that Abhisit made any such order, then he would be guilty of defamation. Sounds as though Abhisit walks the same line as the young Ferrari driver. Case goes on forever until forgotten. Maybe Abhisit's case will move as fast as this case and finish in 2 to 3 years. ... sent from my phone. Would be nice if that were true but many nations have criminal defamation laws as opposed to just being a civil matter. It always strikes me as funny (sad really) that when the UDD lot get a judgment in their favour you don't hear about the bias of the courts. But when the judiciary finds against them, then the courts are biased, in Suthep/Abhisit's pocket/part of the elite and so on. Without the judiciary we would now be living in a country controlled by a hereditary dictatorship with Thaksin at the top telling people to follow his line .... or else. Jaturporn is Thaksin's rotweiller. He's been mouthing off for so long, threatening the state, threatening anyone who stands in his way. I note that the 'biased' courts didn't imprison him, but in effect what they've done is to tell him to behave a bit better than he has done in the past. Really, this man is a monster. Have you ever seen him face to face? I have, and it was not pleasant. An imporant part of Thaksin's campaigns has been/is to control the judiciary. He isn't the only would-be dictator to have done this because if you want to take total control, then you have to usurp the judiciary. I completely agree! It's about time all those people who took the airports hostage a few years ago were given prison sentences. And the "easy lead sheep" are finally out of Lumpini Park, so it should be easy to herd them into jail. Good work Artisi! Keep the faith and we'll clean up this country together! I think you mean 'suspended prison terms'. I doubt any of the wealthy jokers involved over he last few years will even see any jail time. Even Thaksin could have been bailed. Well, I suppose all it will take is someone else to sue him and that case will pull up his sentence and off he goes. I guess there are many to chose from, he has defamed just about everyone not aligned with the Shin clan at some point or other. Isn't he already out on bail for other charges? Out on bail... I assume he has been charged with other offence which he has not yet been found guilty and sentenced therefore the Judge can not consider them as previous offences. I would suspect the opposite, in that many countries don't see defamation as worthy of a custodial sentence, what is more likely the outcome is that the accused would have to pay punitive damages to the person he accused/defamed. So you're quite familiar with the laws regarding defamation in EVERY country then? I would suspect the opposite, in that many countries don't see defamation as worthy of a custodial sentence, what is more likely the outcome is that the accused would have to pay punitive damages to the person he accused/defamed. Consider watching the loads of videos with his endless threats, and ironically, threats that were violent, and in many instances, the following day such things occurred. Fat Haggis Posted May 22, 2014 Share Posted May 22, 2014 Oh don't get me wrong Gemini, I've seen and read plenty of bile come from this guys mouth, and as I said the likes of him the law and the judicial system will eventually catch up with him, the unfortunate thing, and fortunate for him, as the in this case, it was about the Abhisit case, and that the courts are unable to use anything outwith that case against him, the law, and the judges would possibly have loved to have thrown his ass in jail for a very long time, however, they couldn't as the other charges against him had no bearing on this case. A 50,000 baht fine is nothing to this guy, a drop in the ocean.
