90 day report or border run

A friend of mine is on a one year non imm. O visa (retirement) obtained in the US. His first 90 days are up next week. Can he report to CNX immigration or has he to leave the country (border bounce) ??

It's not clear if he has a multi-entry O visa -- which would give him 90 days permission to stay with each entry, or a O-A visa, which would give him 12-month permission to stay with each entry.

He should take a look at the "admitted until" date stamped in his passport when he entered the country. That will tell him if he has to go to the border or not. If it's a multi-entry O visa, then he has to leave the country every 90 days. If it's an O-A visa, then he doesn't have to; he just has to let the local Immigration office know when he remains in the country for longer than 90 days.

i had a non- immigrant 0 - visa for 6 consective yrs

u have to do a border bounce every 90 days,with this visa, thats for sure

with the o-a visa , nancy is on the money

If he has only been in the country 80 days and his permitted to stay stamp is 23rd November then he does not have a non 'O' 'A' visa but he has a non 'O' without the 'A' they are two different things.

Are you sure it's a Non-Imm O-A? If you want answers to your request you have to given correct information. A non-imm O and a non-imm O-A are not the same thing.

If it is a Non-Imm O-A and the expiration date printed on the visa sticker is near, he should cross a border and return using the visa. That will give him a new one year permission to stay.

Be sure it's an O-A and the date you are looking at is printed on the visa sticker, not some permission to stay stamp from immigrations.

Once he returns he will have a new permission to stay for one year given him by immigrations at the border entry, he will need to do 90 day reports at local immigrations office and, since the visa will expire, he will need a re-entry permit if he wants to go in and out of the country.

During the last 30 days of that permission to stay he will need to go to Immigrations and apply for an extension of stay annually (and re-entry permits if he wants to exit and return).

All of what I wrote above assumes it actually is an O-A, but I think you are getting the two visa types confused.
