Tenancy Agreement

Well about to rent my house and wondering if anyone has a tenancy agreement that they could share with me. it would be absolutely great if it had both english and thai on it.

also what is the common criteria used?? such as the tenant filing up a form? copy of his passport or ID? i am lost, please help.

Tenancy Agreement

This Agreement made the day of One Thousand nine hundred and ninety two.

Between

of

(hereinafter called the Landlord),

and (your name)

of (your address overseas)

(hereinafter called the Tenant)

Witnesseth that the Landlord agrees to let to the Tenant who agrees to rent ALL THAT property (with garage, outbuildings, gardens and premises thereunto attached) known as

(herein after called "the said premises") AND ALSO the use of all the household furniture and fittings and articles now being in and about the said premises and belonging to the Landlord and TO HOLD the same from the day of One Thousand nine hundred and ninety two until the

day of One Thousand nine hundred and ninety five at the monthly rent of baht payable in advance on or before the sixth of each month.

The Landlord further agrees, on the expiry of this lease to offer to the Tenant an option to occupy the said premises for a further three years upon the same terms and conditions, at a rental to be mutually agreed.

The Tenant hereby agrees

1. To pay to the Landlord a security deposit equal to one months rental at the time of signing this agreement. Monthly rentals shall be paid clear of all deductions, the first payment (together with the payment of the deposit) to be made on the signing of this agreement.

2. To pay all bills for water, electricity supplied to the said premises and all telephone charges during the tenancy. Agreed meter readings shall be carried out and noted prior to the Tenant taking possession of the said premises. Similarly, at the time of the expiry of the tenancy, agreed readings shall be taken for the purpose of determining the final sum due.

3. To maintain the house in good order and condition. The tenant is responsible for damage or breakage caused by his action or neglect, or that of his servants or invitees. This responsibility does not extend to damage caused by infestation, fire, storm, flood, war, riot, civil commotion or an Act of God. It is understood that normal wear and tear consistent with ordinary occupation of the said premises is expected, and is the maintenance responsibility of the Landlord.

4 That any alteration or extension to the fabric of the said premises can only be carried out with the prior written permission of the Landlord. Any such alteration or extension shall forthwith become the property of the Landlord and upon expiry of this lease no rights shall accrue to the tenant with regard to said alterations or extensions.he has adjusted or expanded. This clause does not apply to fittings installed by the tenant which are specifically agreed to be the property of the tenant.

5. Not to sub-lease the said premises without the prior written permission of the Landlord. Such permission shall not be unreasonably withheld subject to the provision of a respectable and suitable sub-tenant.

6. To permit the Landlord, or his representative, reasonable access for the purpose of inspecting the said premises. Written notice, of not less than 7 days of the Landlord's intention to inspect, must be given. Such inspections shall be permitted only between the hours of 10.00 am and 3.00 pm and shall not be conducted more than once in each three months. At no time shall the Landlord enter the said premises without giving prior notice to the Tenant as specified herein. On no account is the Landlord to enter the said premises unless the Tenant or his duly appointed representative is present. Notwithstanding the foregoing, in the event of an emergency, such as fire, storm or civil unrest the Landlord may enter the premises to protect his interests.

7. Not to permit or suffer to be done on the said premises anything which may constitute a nuisance or which may interfere in anyway with the quiet and peaceful enjoyment by the occupants of adjoining premises. In particular the Tenant undertakes not to permit the emission of noxious or offensive fumes, or excessive noise.

The Landlord hereby agrees

8. To allow the Tenant to quietly hold and enjoy the said premises without any interruption by the Landlord or any person acting for the Landlord, or purporting to be his agent.

9. That the amount equal to one months rental at the time of signing this agreement paid to the landlord as a security deposit will be placed in an interest bearing savings account. The deposit and the interest to be returned to the tenant at the termination of the lease, subject to any deductions for any damage or forfeit under paragraphs 3 and 14.

10. To pay all property taxes, insurance and other outgoings of every description in respect of the said premises (excepting water, electricity and telephone charges which the Tenant hereby undertakes with the Landlord to pay).

11. Warrants that all electrical appliances in the house, including Air Conditioners, Water Heaters, Water Pumps etc. are in good order and agrees to maintain them in such good order at the Landlord's expense.

12. In the event ot the Landlord wishing to sell the property to a third party, and to assign the Landlord's rights and obligations in respect of this lease, then the Landlord must notify the tenant of his intention so to do. Any such sale will not in any way mitigate or affect the rights of the Tenant under this lease. The Landlord further undertakes to advise the Tenant of the price at which he is willing to sell the property, in order that the Tenant may , if he so wishes, introduce a legally qualified buyer.

Termination

13 (a) This agreement shall be terminated at the expiry date specified on page 1, unless the Landlord and the Tenant agree to the renewal of the lease.

(:o In the event that the house is rendered uninhabitable due to Fire, Flood, Earthquake, Act of God, War or Civil Commotion and cannot be restored to a habitable condition within 30 days, then this agreement shall be automatically terminated and all prepaid rent and deposits shall be refunded in full.

14. Should the Tenant vacate the property before the termination of the lease for reasons other than those in clause 13, then the tenant agrees to pay to the Landlord a penalty sum equal to one month's rent.
