Can anyone answer:

1. How can a Thai National get a Schengen visa for more than 90 days?. Either by application or extension.

2. If a Thai national has a Schengen Visa, can they get a Certificate of Residence from wherever?. Any country would do!!

1- That would be long stay, immigration. One would have to apply (most of the time in advance) as an immigrant under national legislation of the country in question. Immigration is restricted in most of not all EU countries though to a selected few purposes (love/family migration, seasonal labour, skilled worker, ...). Just turning up on a short stay tourist visa and applying for longer stay is not very realistic. You would need to check with all EU countries which type of immigrants they welcome.

2- ?? I do not understand the question, if you mean immigration papers/application to settle as a resident, see No. 1: generally if not always done in advance and for a restricted number of purposes.

For France.....Is this true??? Comes from an expat Website and seems to relate to some departments but not all???

A carte de séjour (CDS) or titre de séjour is an official residency card in France. You must have a long-stay visa (Type D) in order to receive a CDS. There is a new law that states you cannot move to France and obtain a CDS without a long-stay visa even if you are married to a French citizen (either before or after entering France.) This law went into effect a few years ago, and not very many people know about it. So do not come to France with the intention of obtaining a CDS without a visa, unless you don't mind wasting money on a plane ticket to go back home just to get a visa.

If you are an EU citizen, or have dual citizenship with an EU state, then you do not need a visa or a CDS.Furthermore, if you are married to an EU citizen (but NOT a French citizen), then you do NOT need a visa in order to obtain a CDS in France.

f you are married to an EU citizen or are PACSed to an EU citizen and can prove un an de vie commune, you can receive the "vie privée et familiale" CDS. You will have the right to work in France at any job with this CDS. It is valid for one year and can be renewed. You may have to do the medical visit again. Your récépissé for this card will state that you have the right to work, but this does not mean that an employer will hire you without the actual card...

Usually only holders of this type of CDS are allowed to apply for ASSEDIC (unemployment benefits). As long as you have a long-stay visa, are PACSed to an EU Citizen and can prove the un an de vie commune, you have the legal right to a CDS vie privée et familiale.

What is true for France?

If it's the highlighted part of a (non French) EU national living in France and having the nonEU family (spouse, children) join them there, that is EU legislation (Directive 2004/38, " freedom of movement" ) and thus applies to all EU/EEA nations. Could eb France, but also Spain (see this topic for instance).

More information on a short term visa under EU/EEA rules is in the Schengen sticky and after arrival the family could apply for residency under the EU directive.

But I'm still clueless on what your situation is and what your goal is?? If you could explain those we might be able to help you better.
