Warranties & Cheap Lawyers

Featured Replies

1) Does Thailand have the equivalent of Small Claims Courts that handle things like failure to fullfill Product Warranty obligations?"

2) What is the best way to find cheap Thai Lawyers? I do not need a lawyer that speaks English, just a service more reasonably priced than the high profile firms with many foreigners. For example, where do they advertise their services? There must be literally hundreds of small and cheap Thai legal firms in Bangkok. I've used one before, and whilst the service left a lot to be desired, it was about 20% of the fees requested by more advertised firms.

3) What is it with the very common insistence that packaging MUST also be returned for retailers to accept product returned under Warranty, surely the warranty applies to the product and packaging has absolutely nothing to do with it under the law?

4) Apparently some of this is covered under the Consumer Protection Act, but can someone point out the salient point in it that apply please.

5) If it's a case covered by the Consumer Protection Act, would it then not be a civil case, and be brought to trial by the government rather than an individual?

5) The option to "Sue" was suggested to me, in the case of a company's failure to fulfill Warranty obligations, but can someone please explain Exactly what "Sueing" entails in Thailand?

I've only ever studied basic law, and that was more than 30 years ago.... I hope someone with current knowledge of Thai laws can help with these questions...

I would suggest you contact:

Consumer Protection Board. http://www.ocpb.go.t...?filename=index

This agency deals with all retails, real estate and alike problems, including faulty products, incomplete jobs, warranty's etc.

It also deals with unlicensed restaurants of food sellers.

As a few of the points you raise are relevant to them, and perhaps they can give you more specific answers to your own particular issues/circumstances.

Thanks for giving links to this organization. I didn't find anything particularly relevant to my questions on the site, but I have contacted them for more information.

The CPB does intervene in warranty and shop disputes, and they can be very effective though of course it will depend on where you are and the person you see.

If you are in a tourist area like Pattaya then the special Tourist Court may also be of use. They do offer a free half-hour consultation with some sort of lawyer, as far as I know.
