Hi I need some information about my overstay here in Thailand. I really appreciate all the help!

I will try to be clear as possible.

I have duo citizenship, Thailand and Sweden.

I entered Thailand with my Swedish passport with a non-o immigrant visa for 1year. I entered with my Swedish passport because I did not have a Thai passport before. This was in 2013.

Since then have I been going to immigration every 90 days for notification of address. In the end of 2014 I got myself a Thai passport.

until today I still not been to immigration office for my notification of my address and now passing about 4 months overdue.

I have some questions about if I am going to pay for my overstay or not, am I in some kind of trouble. Is it possible they will just let me go because I am Thai.

I found some information but can somebody confirm it.

New rules about overstay, will this apply for me? if so a ban on my Swedish passport will not affect me since I am Thai anyways. Please confirm that this is my case and a fined will not apply for me.

Is this my case, on Question no.4 says that I will be fined 200Baht each day and plus 2000baht fine for overstay but says nothing about being Thai citizen and this could affect this maybe?

Any overstay fines based on your entry on a foreign passport will apply to you.

You're going to need to leave the country on your Swedish passport and re-enter on your Thai passport. Most reports indicate that it must be done by air, not overland.

You can pay the fine at the overstay desk at the airport.

Is it possible that I can do this in the immigration office instead of the airport? or is it just better in the airport?

Unless your permit to stay has ended you are not on overstay.

You are just late for your 90 day reporting. The fine for late reporting is normally 2000 baht there is no per day fine.The maximum fine is 5000 baht.

You should just fly out using your Swedish passport and re-enter on your Thai passport. They do not look for 90 day reporting at the airport when you leave.

I think you got a one year extension of stay in August 2014. What you had been doing is reports of staying longer than 90 day in the country since then.

Look in your passport to see what you have.

If you went to do the report at immigration now you would just pay a 2000 baht fine,

If you leave the country you will pay nothing because they do not check for the 90 day reports at the airport when you leave.

I think you got a one year extension of stay in August 2014. What you had been doing is reports of staying longer than 90 day in the country since then.

Look in your passport to see what you have.

on the white paper from the immigration in the passport it says this is not an extension of stay please notify your address again on January 2015.

I did mention after my post was sent out that I payed immigration officer around 2000 baht in august 2014 but i did not know for what though. i dont have the stamp...

btw yes I did pay around 2000baht in august 2014 but i did not know for what though.

This could be a little bit difficult as I understand that Thailand does not recognise duel citizenship. So possibly best to just fly out pay any over stay and return with Thai passport. End of problem as you won't be flagged up even if you are told not to return.

The only way to avoid the overstay would be to get legal help to contest having to pay the fine since you are a Thai citizen.

Best to pay the fine on the way out of the country at an airport.

Going to an immigration office can be risky since you would not be able to apply for another extension.

This could be a little bit difficult as I understand that Thailand does not recognise duel citizenship. So possibly best to just fly out pay any over stay and return with Thai passport. End of problem as you won't be flagged up even if you are told not to return.

No need to start a debate but Thailand does recognize dual nationalities.

There is no ban for having an overstay. That was never approved.

In order to pay an overstay at a immigration office you have to be able to get an extension to clear the overstay. In the past the would give you 7 days to leave the country after you pay 1900 baht for an extension.

The airport is certainly your best choice. Just pay the fine on departure and leave then return using you Thai passport.

Don't forget to switch passports before you arrive in the country you fly into (except Sweden) as you must leave on that passport.

Only if he was under the age of 30.

He is already registered in a house book and has a Thai ID card that allowed him to get a Thai passport so he would of been already subject to the draft no matter what passport he entered on.
