My travel buddy has overstayed his entry permit by 55 days and we will shortly be going on a side trip within Asia and returning to Thailand within a wek of leaving. We would like to know what will happen when he gets to the airport. Does he have to pay the max 20k bht overstay fee and then can return to Thailand a few days later or are there any additional penalties?

I have read on another thread that since the max overstay fee is 20k bht (= 40 day x 500bht) and he has overstayed 55 days then he might get blacklisted for overstaying past the max fine or over 40 days?

It is very unwise to overstay in this way.

If he is caught in a random check he will land up in the Immigration Detention Centre and the be deported.

Your friend should go to immigration and legalise his situation.

He will be fined and will have to leave immediately, but I do not believe he will be blacklisted.

I thought the only solution was to hit the departure desk at the airport, paying the fine on the way out.

No.

Turning yourself in is OK.

It is effectively what you have to do at the airport.

Even then he will get referred to a more senior officer who will deal with the overstay and collect the fine.

Thats correct - when you check out at the airport just stump up the cash - I know someone who overstayed 9 years. His logic was that the fine he had to pay was a max of Baht 25K (is it 20K or 25K - can someone clear that up), and reackoned that actually he had saved a ton of money, versus all the 30 day stamp runs and the cost of doing those runs over 9 years.

And that is exactly what has happened - he got a bit of a lecture, paid the fine and a little bit more (which was greatfully accepted - as always), and that was the end of the subject.

No blacklist threats, no deported stamp - nothing like that - just pay up and go.

Different story though if you get nicked in the street for some or other reason - you may well find your slef at the detention centre for a few days............... and pleasent by all accounts.

Thanks for the resposes. We are well aware of the consequences of been caught on oerstay but usted wanted to clarify the situaton when one arrives at the airport. So i guess he jut pays the 20k and that is all. Cheers.

make sure he is sober and dressed proper to impress the officer also a a USD $100 bill tucked away for safe keeping could"nt hurt...

good luck and let us know how you make out im curious because i've over stayed by 60 days before and back then 100bhat per day and they gave me a tounge lashing from a higher up and let me go..

minus my fine and my booze and ciggies but i had a clean passport and returned two weeks later WITH A VISA no problem...........

When I accidentally overstayed by a couple of days last year. I was given a lecture on the consequences of a repeat. Namely I would have problems getting back into the country. It was genually an accident, I was a little unwell and convinced my visa had a couple of days to run. It would be intertesting how the new regime views the matter though.

I was talking to the "overstay" officer at the Friendship Bridge in Nong Khai a couple of weeks ago and he told me that if someone had overstayed beyond the maximum fine ie: 40 days X 500 baht = 20,000 baht, then he was required to call the police to arrest the 'overstayer'. He told me that for a large overstay the only place to go is Bangkok airport and have the fine (20,000 baht) and an outward ticket ready, even then it is up to the officer dealing with the offender to decide if he should be 'blacklisted' so I would say you should dress well and offer lots of respect to the officer when you are being dealt with or you may regret it.

I thought they have changed the 20K overstay maximum penalty to 500 baht per day no matter how long you overstaystay,, say for example you overstayed for 1 year (365 days) that would be multipied to 500 baht... :o:D

AFAIK the maximum is still 20,000 baht but if you are beyond this maximum you should go to Bangkok Airport and pay your fine, if you go to a land border you can be handed over to the police and arrested.

As a former bureaucrat, I see the excessive overstay (owing more than 20,000 baht, for overstaying more than 40 days) as a whole 'nother category, like from a simple administrative fine to a misdemeanor CRIME. Note that in most cases here, any officer at the desk can accept a fine, but as soon as it becomes a very long overstay, you're shunted to a superior officer's desk or private office.

Is it only logical that overstaying beyond the maximum fine exposes you to imprisonment?

I overstayed three days, had the medical proof that it was unavoidable, and still got a stamp in my passport and I paid the fine.

how do you explain that?

I just forgot it the last 9 years?

I couldn't find my passport so I could not check?

I couldn't read the stamp I thought it means 2007 instead of 1997?
