Change from ext. based on retirement to ext. based on marriage

I have been using the extension of stay based on retirement for the past 3 years without a problem.

I had thb 800k in the bank throughout that period, untouched. Earlier this year I needed to dip into the 800k to the sum of 100k leaving 700k in the bank account. In August this year (28th) I topped the account back up to 800k. This on the assumption that total of 800k had to be in the account 2 months prior to applying for the extension. Unfortunately, I was wrong! (I obviously did not read all the posts on Thaivisa)

Yesterday, at the immigration, I was denied an extension due to the funds (the total of 800k) not having been in the bank for the required 3 months, but only 2 months. This means that as from tomorrow I shall be in an overstay situation.

As I see it there are a number of options open to me.

1) obtain a proof of income letter from the British Embassy and re-apply using bank funds together with income.

2) Change the application to extension of stay based on marriage. (with all the complexity that goes with this)

My questions are regarding 2. As I understand it, there is a waiting period of 30 days from date of application. How would that effect my overstay situation? i.e. would I be in overstay for 30 days or would the date of application stop the overstay status.

Does immigration keep the passport for the 30 days under consideration period?

You could apply for a 60 day extension to visit your wife and then apply for the one year extension when the money is in the bank for 3 months.

Your wife will need to go with you when you apply. Marriage certificate plus a copies of your wife's house book registry and ID card.

You can also obtain 60 day extension to visit wife and then continue retirement extensions - expect they would welcome that and would not require home visit or perhaps as much documentation.

If you need to use the Thai wife extension the 30 day under review will not be overstay - you are allowed stay from date of application.
