December 10, 201510 yr PM wipes clean legal hurdles over NACC bossTHE NATIONPanthepBANGKOK: -- Deputy Prime Minister Wissanu Krea-ngam said yesterday that the prime minister had relied on his absolute power under Article 44 of the junta-imposed interim constitution to remove the legal snags related to the selection of the National Anti-Corruption Commission (NACC) chairman.Prime Minister Prayut Chan-o-cha, in his capacity as chief of the National Council for Peace and Order, issued an order to dismiss Panthep Klanarongran so as to select a new chairman and seek royal endorsement for the replacement along with five other NACC members in one go.There had been a legal debate about the NACC members not being eligible to select a new chairman because they have not yet been royally endorsed. The NACC had earlier issued an order allowing Panthep to continue as chairman without indicating when he would step down.To remove this legal hurdle, Prayut had to remove Panthep and get the five new NACC members to meet with the remaining members to select a replacement. The five new NACC members are not allowed to discuss other subjects.Source: http://www.nationmultimedia.com/politics/PM-wipes-clean-legal-hurdles-over-NACC-boss-30274690.html-- The Nation 2015-12-11

December 11, 201510 yr Yes, need to make sure that a certain recent scandal is properly investigated by a hand-picked NACC.
December 11, 201510 yr One might think that a requirement for royal endorsement is not just a legal snag. Royal endorsement is an inherent process prescribed by a democratic constitutional monarchy memorialized by Article 1 of the NCPO Interim Charter as endorsed by the monarchy. Therefore, Prayut's act of not only disagreeing with a royal endorsement but also bypassing the royal endorsement would seem to be LM violations. Prayut has shown that the military is not above this law as witnessed by recent arrest warrants against some military officers. The NCPO allegedly promotes judicial equality under the law. Perhaps Prayut should then do the right thing under NCPO's own rule of law and place himself under arrest. Or remind the Thai public why once again under Article 44 that the NCPO, its subordinates, and their sub-subordinates (sic) are immune to any prosecution to the rule of any law for their past, present and future actions.

Logic, logic and this post. According to your logic once someone is royally endorsed he/she cannot step down as that would mean disagreeing with the endorsement. Such as you say may be an LM violation. Anyone who has stepped down previously should immediately go to the nearest police station to place thermselves under arrest.
December 11, 201510 yr Yes, need to make sure that a certain recent scandal is properly investigated by a hand-picked NACC. Yep. I was thinking the other day about the "list of 100 corrupt officials" that received attention some time ago. It went through a vetting process with the Chair of the NCPO, the PM. There were some members of this forum who thought that was about reducing corruption. How I wish I could recapture my youth, and a mind free from experience. Or, as Bob Seger sang, "I wish I didn't know now, what I didn't know then".
