UK Tax on Private Pension

Featured Replies

Many moons ago I started a pension plan with Abbey Life UK and cancelled it after 1 year.

A few months ago they sent me a letter and informed me the policy was due to mature and provided some options on what to do with the small payout. I then informed them just to send what was available to my bank account. When I checked the letter they sent me I observed 571 GBP had been deducted and given to the HMRC.

I am non resident and have zero income in the UK. Many years ago the HMRC sent me a letter to my Thai address and told me there was no need to fill up any more tax papers unless I started receiving income in the UK

My question is can I claim back this tax that was deducted ?

Yes you can, as long as you don't have total income from the UK that exceeds the personal allowance. That being the case, write to the revenue or fill out a return to reclaim the tax paid.

Thanks for the fast reply; I am way out of touch regarding the UK tax system do you know what form I need to fill out to reclaim the tax deducted.

Sorry I can't help with that, I'm even more out of touch with such things. Somebody will come along shortly with that answer, I'm certain.

In order to claim tax relief for any income in the period 6th April 2015 to 5th April 2016, you would have register for online self assessment, and submit by 31st January 2017

Non-residents can not correctly complete their returns using the HMRC system. (It doesn't cover the residence pages.) It requires third party software or sending a paper copy.

a friend and i just did a non residents tax return, all online and accepted by HMRC. your form SA109 never came into it.

I think the OP can claim his tax back by using form R43:

https://www.gov.uk/government/publications/income-tax-claim-to-personal-allowances-and-tax-repayment-by-an-individual-not-resident-in-the-uk-r43

This is for people who have no need to fill out a self-assessment form, which is apparently the OP's case as he has no other UK income.

HMRC is rather lax about that, but the rules are clear cut: non-residents must not use the HMRC online system because it can't correctly calculate their tax. (It actually overtaxes non-residents.)
