Washington (CNN)A Navy SEAL who helped kill Osama bin Laden allegedly kept an unauthorized photo of his corpse, The Intercept reported Tuesday.

Matthew Bissonnette turned over a hard drive that contained the photo to U.S. investigators in exchange for an agreement that he wouldn't be prosecuted for unlawfully possessing classified material, according to the The Intercept.

CNN cannot independently confirm this report. Naval Special Warfare Command referred CNN to the Naval Criminal Investigative Service and calls to NCIS were not returned.

Is there something wrong with possessing classified material? I know there is nothing wrong with keeping it on your personal unsecured email server. Isn't that sort of the same thing?

Not to get all conspiracy or anything but... was it really bin L.? Why is there no public photographic evidence? If one looks at this in a dark way, this is a US govt ploy to make it appear there is actual evidence of the murder.

Actually there is something wrong with possessing classified material...after you leave the government.

Every employee of the US government that holds a security clearance, whether you be a SEAL or Secretary of State, signs form SF-312, during out-processing that states one no longer has classified materials in their possession. This oath is taken under penalty of perjury if one is discovered later to still possess classified information.

The SEAL would appear to be in violation of his oath on SF-312 if he did still possess a photo of the deceased Bin laden.

There is one other recent case where a federal employee took over two years to turn over roughly half of their correspondence to the government, while being held by an uncleared contractor without facility clearance.

She signed the same form SF-312, as did all her aides.
